by asking for more evidence, this mean they are not convinced with the papers and evidence you provide first time. By sending the same documents again to them. You will raise their suspicion again. 

 

Careful of what you doing here. You may red-flag your case by this action. Once your case is red flagged. Then good luck getting what you want from them. 

 

Just telling you here, USCIS now is auding all the cases with much more scrutiny and they will not grant anyone civic rights or naturalizations of they suspect something wrong. Any red flag will send your case to fraud officer then you will be deeply scrutinized and your file will be opened and every single detail will be revisited.

You've nailed it. You have obviously already proven you're in a bona fide marriage, making this RFE all the more ridiculous. 

 

Like I said. Lawyer up. Withdrawing your application is not something to be taken lightly.

If we withdraw the N400 it won't go to the fraud office. Then he can reapply under 5 year rule next year.

What you've described to me does not at all indicate this is headed to the fraud office. Don't get freaked out by one poster making assumptions about your case!

I am not here to scare you or intimidate you. I am just drawing your attention to simple facts about your actions. I suggest you wait. Since you applied everything and i hope they will approve it and you mive on. If it is not approved or they request different evidence. You talk to a lawyer 100%. Do not act from your judgment or read forum tips after this point of another rejection. The lawyer will be your destination. Good luck.

I agree with Birchscott.

 

Hang in there. Sending the same info is NOT fraud. You said you sent extra info, so that's in your favor. If you are concerned get legal advice. In the mean time, why not open a joint bank account or joint credit card. Find pictures of a joint vacation, boarding passes of same air trip etc. Anything that shows you both doing stuff together, like family parties, etc.

If you are in a legit marriage, you don’t need to stress yourself over this. If your marriage wasn’t legit, they weren’t going to approve your I-751 in the first place. Except USCIS is saying that the evidence that were used to approve your I-751 was done in an error and therefore, they might want to get more evidence  for your naturalization. Remember, all what I am saying is based on assumptions. I am not saying it’s the case. Did you file taxes as “married filing jointly or separately” for the past 3years? If you did, send copies of those taxes to them. Do you have bills that were mailed to you guys for the past three or more years of being together? if yes, send copies as well. Also, if you don’t have a joint account, it would be better to write a letter explaining why you guys aren’t comingling finances. Some marriage couples have separate bank accounts and do share the cost of living expenses by writing individual checks. I don’t think  it’s mandatory to have a joint bank account together if you have other proofs to show that your marriage is legit. However, having such evidence will add a huge plus to your application. I just got approve for N-400. During the submission of my application, I added cable bill statements for the last three years, car note statements for the last three years, tax return for the last three years, Heath Insurance Card, Car Title and Card Insurance, and bank statements for the past 3years. Most of these companies that mailed you bills have an online system that have copies of your bills. Go on their website and download any doc  that’s available and attach them to your application. If you can’t upload additional documents anymore, download the RFE letter and mail your additional documents via mail. If they decide to transfer your application to fraud, the fraud officer  will need to investigate if your marriage is legit. If my marriage is legit, I wouldn’t even stress myself because I know at the end of the day, my application will be approved. I think, withdrawing your application at this point will raise a red flag. Again, it’s assumption. Why would you be in a legit marriage and when ask to provide evidence of your marriage, you decided to withdraw your application? Do you have something to hide? This might a question that come up in the IO mind. If USCIS isn’t satisfied with your evidence, they will deny your application. Could this trigger an investigation into your previous application based on the evidence you submitted? It could or it couldn’t.   Wishing you all the best.

All taxes are filed joint. Sent all taxes, all leases from the past 3 years. Included health insurance claims, a convention ticket, and Co op memberships. Included a copy of health insurance card. The utility bills I only sent the last six months as I had hit the limit in the amount I could upload. It said in myuscis "you only have one opportunity to respond to RFE". So I have no way of sending any additional. Our marriage is legit. We just don't have much of a paper trail.

Don’t stress out! You will be fine. As long as your marriage is legit, everything will be okay. I think, what you sent should be enough to convince the IO that your marriage is real. Except where the IO wants to be a pain in the a**

This same amount of paperwork was brought in a binder to his interview. His IO flicked through it a couple times. But didn't take anything. I feel like if he would have taken it this wouldn't have happened.
