Hi everyone!

 

Brand new user and I apologize if this has been asked before, but any help would be appreciated  (couldn't find answer on Google after hours searching). I met the love of my life in Indonesia and can't wait to live with her in the US. Plan is to marry in half a year probably in her home country. Then we can file the CR1/IR1 but it would take about a year plus the months between now and Dec. Would it be possible (please read the entire sentence) for her to come to US on a visitor's visa, we get married at a court house, then she returns to her home country, I file for the CR1/IR1 immediately and we still have our ceremony later on in her home country? Would this be a feasible way to shave off the months between now and the big home ceremony in her country? Please note, I have no intention of commuting fraud or breaking any laws. The risks would be too great and disrespectful to all the opportunities this great country has given me as a citizen born and raised here.

Sure, she can get married in the US upon entry with a B2 and then go back to Indonesia while you file for CR-1in the US :) Ceremony in Indonesia can be held later and it won't affect your application.

A CR-1 takes 12-14 months for her to get her visa in hand. She will be a conditional permanent resident when she enters the US and can pretty much works immediately afterwards.

 

If you go the fiancé visa route, it will be about 6-8 months. However, she'll need to file for AOS + EAD + AP after marriage. She cannot work till she gets her EAD.

I don't know the answer to this, but it may take several months to even get a visitor visa. I'm not familiar with the procedures out of Indonesia for it. But you may want to consider that too. If it takes three months is the added expense of her coming here etc worth it for a month saved?

Does she have a lot of ties that would make her approval chance greater? B2 is not an easy visa to get,  and the fact that she's coming to marry you will be a huge burden to overcome. Or does she already have the B2? Have you considered the k1 instead?

I have to agree with this as well. As soon as she says to the CO and to Immigration at the border that she is going to see you to get married she may very well get denied. But NEVER EVER lie to the CO or Immigration because it can come back to bite you both in the long run. So just be forth coming and honest.

Wrong......It is perfectly legal to come to the US, marry here, then leave.......It is Not legal to come to the US on a visitor visa with the intent to marry AND STAY.  However, the fiance should be prepared to provide evidence that she/he will return to their country.  In addition, the visitor should always be truthful when asked about the purpose of the visit.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you all for your answers and the link to the uscis site as well. From what I can tell, and agree with, missleman is correct. I wanted to basically clarify that that was possible, so as to avoid any potential fraud. I'm just trying to speed up the process, but I have absolutely no intention of bypassing the system or abusing it and risk losing everything.

Chances of her getting a b2 visitor visa from indo is slim! Won't happen u less she has strong ties. Property, money, career ect..

 

Apply for a k1, have her come here and marry her here in a quick court house weddinf...apply for aos and then get your AP and once that happens go back and do a marriage there.

 

 

Trust me, nothing is fast and their is a give and take for everything. It does suck. So welcome and enjoy:)

Be aware that the visitors visa is VERY difficult to get.  I have a few friends who were denied.  

 

You have some great ideas but the approval rate for visitor visas is quite small compared to K-1/CR-1.  Look honestly at all options.  You may find the K-1 to be slightly quicker and more reliable than the tourist visa.  The CR-1 takes a few months longer than the K-1 but she will have a green card upon final arrival as your wife.  

 

If she gets the tourist visa and you marry her here, she will have to go back to Indonesia while the CR-1 gets processed.  If you marry her here and try to keep her in country, that is visa fraud and could get her permanently banned from entry.

 

Rose and I went through the same thought process and we decided that the K-1 was the correct choice for us.  While we understood the wait time, we also knew that we would end up together someday.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

After all these wonderful answers, I think the best thing will be to just get married in Indonesia and then file the CR-1. It will take a little bit more time, but I think the risk is minimized. K1 would be best, but our wedding ceremony is already planned for sooner than the K1 would finish processing and then we'd have to start all over anyway.
