Filling out form I-765

This is for my daughter in law's case. She just got married with my son who is a USC, she is now filing for AOS and I-765. Does she need to use her last name or her married name? Appreciate your help!

Timeline

Depends on which name she prefers. If she wants to take on her husbands name, use that one for all documents from now on. If not, then stick to her own name. Decide on one and stick with that for good. 

Her marriage certificate is proof of her name change if goes with her husbands last name.

It also depends on her passport, if she already made a name change. My wife, made the name change in all of her official gov document  

04/21/2016 : Married

11/17/2016 : I-130 sent ( NSO marriage certificate took forever) 

11/23/2016 : I-130 case accepted notified by email NOA1

01/27/2017 : USCIS APPROVED NOA2

02/04/2017 : NOA2 hardcopy received in mail

02/28/2017 : Case received by NVC

03/02/2017 : Agent assigned 

03/07/2017 : Case number assigned with invoice

03/28/2017 : Fees paid (IV and AOS)
04/05/2017 : DS260 online form completed
04/09/2017 : IV and AOS package sent to NVC
04/12/2017 : Requested for NVC expedite
04/17/2017:  NVC expedite approved 

04/18/2017:  In Transit 

04/20/2017: Received in Manila (may schedule for interview)
05/11/2017: SLEC -CLEARED 
05/25/2017: Interview @ Manila Embassy - APPROVED

05/30/2017: VISA on hand plus packet

06/08/2017: POE: California  

06/14/2017: Social Security card received through DS260 filing

06/24/2017: Green card received 

 

CRBA 

04/10/2017: CRBA sent to Embassy via FedEx 

04/19/2017: Appointment scheduled 

05/04/2017: Interviewed and approved 

05/17/2017: CRBA certificate on hand

05/26/2017: U.S Passport on hand

06/02/2017: Paid for ECC and Extension fees

06/08/2017: POE

She  has not change her passport name yet. She plan to change all her government ID's, including her school ID after her AOS

She can use her married name in the name section. Thereafter, input her maiden name under 'Other Names Used'. 

 

FYI, she's not required to change her passport in order to use her married name in her AOS, EAD and AP applications provided that she has changed it at the point of marriage on the certificate itself. Then the marriage certificate will work as her legal name change document. Make sure to enclose a certified copy of the marriage certificate to prove the marriage and name change.

 

But of course, she will still needs to update her SSN, US bank account etc since she has changed her name at marriage. She can take her time to get her foreign passport updated after the AOS or prior to the passport expiry and it won't be an issue nor would it stop her from using her married name on the USCIS applications.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

In their marriage certificate, the name reflected is still in her own full name and last name. Will it be changed automatically if she use her husband's last name in her AOS, and I-765? She wanted to change her name to her marriage name bec. they're already married. thanks again.

She doesn't need to change government IDs prior to using her married name when filling out the I-765. She should put the name she intends on using.  The rest can come later.  No they won't change it automatically just because of the marriage certificate. Not every new bride changes her name to her husbands. They don't know your intention.  You must complete the form with name you are using.
