Prior marriage question, whose fault?

If they ask whose fault or why you are divorce? should i blame her or just say she was out of relationship and ask for divorce, or do i need to tell she was cheating with me which was true. but blame seems not good. what do you think, please any suggestion appreciated.

General speaking as everyone in this forum will suggest you do so, please be honest with the IO about your divorce if they asked. Don't need to blame anyone, just be honest tell what happened.

I want be honest and tell the whole story, but my lawyer is saying, keep it as short it as possible, the more you say more danger or repeat question will come, if i tell there was another man, she was cheating, etc. then can IO suspect something else?  so its about blame, she was asking divorce not me, she initiated.

The statement "irreconcilable differences" covers most situations imo.

If asked more then elaborate.

did you get your green card based on the marriage to U.S. citizen yet ? if so, the officer might spend more time asking questions about your prior and current marriages. They dont want to see people tried to cheat in the marriage for the benefit of becoming citizens. Actually, lots of people did that for purpose.

 

N400, Information A

1. You are at least 18 years of age and:

A. Have been a lawful permanent resident of the United States for at least 5 years.

B. Have been a lawful permanent resident of the Unted States for at least 3 years. In addition, you have been married to and living with the same U.S. citizen "spouse" for the last 3 years, and your "spouse" has been a U.S. citizen for the last 3 years at the time you filed your Form N-400.

 

----Does it mean that, you need to still be  in the marriage with the same citizen who sponsored your green card for 3 years till now when you are filing N400 ? as USCIS uses  word  "Spouse ",which is only applied in the valid marriage. I dont know if your ex-wife(husband) who sponsored your green card is still counted as "SPOUSE" since you guys were divorced. USCIS has big concerns if applicants who benefited from marrying US. citizens are playing games in the marriage and not responsible well enough for maintaining the marriage healthy,especially for naturalization purpose. the USCIS officers know there are lots of dark sides in marriage like this.

if that's the case, its better to tell the whole story, i don't tell anything, they OI might think i was play games. but i dont, she was playing games as she has the US citizenship, i don't think any immigrant what a divorce, bcoz they know the danger of it.

Focus during the interview will be totally different between 5 and 3-years residency rule. 

you questions at the beginning was totally misleading...as default, people would think you are filing under 3 year rule.

Agreed with the poster above me. I believe Applying under 5 years residency, they will take a look on the past 5 years of yourself more than look further to your past marriage. Such as: Showing Good Moral Characters, not own any taxes...
