 I am widow and and i have 2 children 10 and 6 years old. I am working on bringing my sister from the Philippines to help me and help me and help me take care of my children during my treatment and chemotheraphy.  I will be having surgery in September but treatment will not start till maybe October or November    Any advise on how to process the emergency visa?

There is no such thing as an emergency visa for family to help take care of you or your family during sickness. The embassy will deny a tourist visa application and if CPB thinks she's going to perform the work of a nanny or caretaker, she will be send back on the first plane home. 

My deepest sympathy for you situation, though. Stay strong.

The only thing your sister could do is go with you to the hospital. You do need someone with you if you are going under anesthesia (like for the surgery). For that she would need a visitor visa.

 

However, as the others have said, your sister cannot immigrate to the US in a short amount of time, nor she can be a caregiver, nurse, or take care of the kids under a visitor visa. That is not the goal of the visa.

The only shot your sister has is to try apply for b1/b2 visa to be your moral support during such a tough time.

 

if she doesn't have strong ties to

the Philippines such As a good job, business, home, kids, finances she will likely get denied.

Even it She comes on The tourist visa, she it not allowed to perform work like taking care of children. It's considered taking job from the US citizen, hence illegal on tourist visa. 

 

If you need help, you have to consider hiring a babysitter or caretaker.

Well it depends on how you look at it.

You can have a family member watch your kids and its not considered a job, families do that all the time, but if they state it in a way that looks like a job, then for alarms will sound.

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

if you come from a different country and preform a  task that she would have to pay someone to do it is considered a job.

grandparents are denied entry if they are going to watch the grand kids while the parent is at work or they are out on a date since that is something she could pay someone to do.

it does not matter that families do it for each other in the us since they are all allowed to work and coming g on a tourist visa that does not allow work makes that person watching the kids violating thier visa. even if they did not intend to work when they entered but did it is still a violation and coming here for the purpose of violating the visa is even worse.

Wouldn't this be a gray area?

 

Before i landed recently with my immigrant visa and was on tourist a few times, i did cook for my husband, his kids were at home sometimes when he was at work.  Is that really illegal?

I guess it would depend on what they say as reason for the visa and when they enter.

I'm sure there's lots of people that come for legit reasons and end up doing this stuff.

Half those here illegally entered on visa's.

 

Probably the most practical option is for the children to stay with Sister.

No, it is not a gray area, it's black and white. A family member cannot travel to the US with a visitor visa to the to be a caregiver. Period. End of story.

Being a wife and taking care of a husband and his children is not the same. You're comparing apples to oranges.
