Hey everyone,

i started my green card process at 2014 when i was 17 a little bit before i was 18 (F2A) while my dad was holding a green card now my father became us citizen after nvc approved everything and changed my status to F1 and im gonna be 21 only at October. How its can be? I supposed to be IR?

looking at visa bulletin you should have already put your application for a greencard in. f2a is processing people from 2015 right now. you should contact NVC to see if you can still put in an application since you may have waited too long.

But the point is if they not gonna approve that I still supposed to be IR1 and not F1. And if I started it when i was 17 so its keeps that im under 21 until the case over no? Cuz its not my fault that I didn't got it yet.

it is your responsibility to be on top of your immigration case not thiers.

 

being under 21 when it was applied for only keeps you from aging out by the number of months it took them to approve the i130. 

 

my advice is to forget the other petition and have your dad file a new i130 and i485 within the next 2 weeks. since as long as the i485 is filed before you turn 21 you are still considered when they decide on it. also talk to a lawyer or two to make sure what I said is valid. tine is not on your side so do hurry.

If we will apply again so they probably will put me again as F1 no?

and i can visit at the us by that time right?

im sorry about all those questions I just a little bit stressed cuz i was about to get the visa interview for the F2A and they changed it at the last second.

f1 is if you are over 21 have children or are married. if not then you are ir2. it should be automatic. I do not know how best to expedite this. I would get the medical scheduled soon and call the embassy to see if you can get interviewed right away and hope you can get the visa before you turn 21. since it gets more complicated if they allow it.
