Overstayed Visa as a minor

Hello Everyone.

 

I came into the united states on a visitor visa on 05/21/2001 ( I was 5 yrs old at the time) I then went back to my country (Colombia) on 12/09/2003 ( I was 7 yrs old at the time) and i have never went back to the United States since then. My father is petitioning me and he is a US Citizen we got the petition approved and am now filing out the DS-260 and am worried that i wont be able to get my green card because of the overstay of visitor visa in that time.

 

Will i be denied my green card at the embassy in Bogota because of the overstay? I read somewhere that if one was 18yrs or younger before the overstay they will not be "penalized". 

 

Any help/info would be greatly appreciated.

For minors it is forgiven.

It's not even forgiven, they just don't have overstay to begin with.

 

You must be at least 18 before you begin to accrue overstay.
