Best way going about getting married to USC

Timeline

Hi,

 

I believe I have posted on here in the past, I am curious what is the best way for my gf and I to get married. She is in Buffalo Ny and I am in Ontario. I visit very frequently as I work in Fort Erie right on the border. I thought about going to get married, and then just coming back to work the next monday. Maybe a take a week off and then come back to work. I do not think it is illegal to go get married and come back it is only illegal to get married and stay if I cross for the intentions of visiting.

 

If I do decide to stay for a month or so, what would be a good time to go and get married, after how many days.

 

We want to get this done in about 2 months time

Timeline

You can cross the border to get married and remain for the month then return to Canada and file for CR1 visa. I did that. I stated at POE that i was there to get married. I also stated when i would be leaving. I had no problems. 2 days after arriving my now husband and i went anf obtained our marriage license and we got married a week later. I stayed an additional 2 weeks then left. I then returned for a visit 7 weeks later and we compiled the petition for CR1 which in my opinion is far superior than k1 visa.  Good luck on your upcoming marriage. Please note CR1 takes 12 to 15 months typically. Could be less could be more. Please do research for the pros and cons of CR1 and K1 and then make the decision that best suit you and your partner.

You can get married after any number of days. Some states have a minimum waiting period for a marriage license, but it's usually just a few days. I think NY is only 24 hours.

 

There's nothing illegal about getting married when you visit. So long as you don't intend to go home, there's no issue at all.

Be sure to check the requirements for NY State as they may differ from NYC, I got married in NYC while she was visiting, there was some confusion over if we needed her birth certificate, in NYC we ended up not needing it.

Buffalo probably has a site for the clerks office with more info.

If you're able to visit regularly I'd say go CR1, that way adjustment of status is all taken care of when entering.

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think that is the way to go,.. the lawyer advised us to do a two step process, like getting married and coming back and then filing a ds260 of some sort.. and then another form. if i come back to canada do i need to still do an adjustment of status. also if i get married and just stay what kind of legality am i getting into.

The CR-1 is a good choice in my opinion.  Within a month after entering the US (with the CR-1), my wife had her social security card and her green card.

 

1.  With the CR-1 visa, there is no Adjustment of Status..a Green Card is the end result.

2.  You can not legally come to the US with the intent of getting married and staying.  It is immigration fraud, and it can bring very serious consequences.

I understand your number 2. so if i do enter get married and go back to canada i have done nothign wrong..

 

and second how look do you usually have to be in the us with a change in heart or mind to get married, out of the blue so to speak

What youre saying then is the best thing to do is go get married and just go back to work the next week or whatevr and then file and just deal with the border everytime saying im going to visit my wife?

I'm not sure what you mean by this.  You already intend to get married.  There's nothing illegal about planning to go to the U.S. to get married.  What's not legal is entering as a tourist with the intent to marry AND live in the U.S.  

I entered as a tourist with no intention of getting married but life happened and I did get married and was legally advised to simply stay and AOS.  That's a completely different situation and there's no magic time period where changing your mind is suddenly acceptable.  If you already have the intent to marry-which you do-you have two options.  The fiancée or the spousal visa.
