Hey 

My friend passed her n400 interview couple days ago, she passed her english and civic test , answered all n400 application question, in the end the officer gave her  form with ** decision cant be made**.

Back to 2015 she got arrested for something that someone eles mistakes but she cant proof her innocent, she took a plea deal PTI, she completed her term of supervision and paied fine, in the end she wasnt convicted nolle plead guilty, and the case was dropped, the question is do you think the suppervisor will denied her application event though the officer said he didnt see something wrong with her file? Any situations or cases were similar and got approved??

Any information is appriciate, thank you so much.

How was she nolle prossed after completing her sentence? 

 

It it might be useful for your friend to register for her own account, rather have someone post on her behalf. Stories often get confused this way.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Depends on what the charge was, whether she showed the officer court-certified documents during her interview, etc.  

Odd that she is innocent, yet she took a plea deal?  Doesn't make sense to me....in any case, a term of supervision/fine/plea deal is all a finding of guilt in USCIS's eyes, whether the case was dropped in the end or not.

 

Hopefully she had court paperwork to show during her interview?  If not---she may get an RFE asking for her to submit those before any decision is made.

 

She probably should have waited until the arrest date was outside of her statutory period before applying for the N400, but too late now.  She may get lucky.

It's a good chance she may get denied, based on that charge.  Fraud is one of the CIMT (crime of immoral turpitude), and since it happened within the statutory period of her filing, they can use that reason alone to deny her application....she would be able to apply again, if denied.  

 

Was that her first offense?  Any other arrests/charges/traffic violations on top of that?

Just this offence, nothing eles, and ot was for stupid reason that they charged her for that, her lawyer took her money and did nothing....even if the officer said he didnt see anything wrong with her case you think they will denied her.

Her application would be looked over by a supervisor before an approval/denial is made, due to her criminal background.  The supervisor would make the final decision.  

 

Again, she may get denied, she may not.  No one here would know 100% either way what the Supervisor will decide, only he/she knows.
