Hey guys,

I'm new here and unfortunately I haven't found an answer to the question I'm looking for.

We are filing for Adjustment of Status (K1 Visa) Greencard application. My husband started a job in January this year (2017) . Before that he was traveling overseas and therefore unable to provide tax returns for 2016. Is he eligible to be the sponsor if he cannot show Federal Income tax returns and W2 Wage statements for the last 3 consecutive years?

I hope someone can help

He can sponsor as long as his current expected annual income meets the 125% :) Make sure to get an employer letter and gather his paystubs from his current job.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I was wondering what does the letter from employer has to do with this and what is it suppose to say on there.

OP's fiancé just started a new job in January 2017. 2017 tax is not filed yet so no tax transcript that shows or prove a history of income that meets the poverty guideline. Due to that, a letter from his employer stating his position, whether permanent or part time and his current monthly salary or current expected annual income would help substantiate his claim of $x amount that he has listed on the I-134.

From the VJ guides:

 

"(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)".

 

Taxes or not, they normally want to see this as proof of your current situation and actual ability to support your fiance given the present situation.
