I am wondering if anyone can help. I am getting ready to send back my checklist. Now thing is....my fiance is a farmer and of course his income is not HUGE. I am worried I will get rejected (since it is me and my 2 girls) that he is sponsoring. He does not have a problem paying bills...he owns heaps of stuff. Has a moderate savings as well as investments. But its the "farm income" on his taxes that show a small amount. I really don't know how taxes work but I'm a worrier and I don't want to get denied after ALL of the work we have done.

Anyone???? :help::help::help:

Oct 1/09 - I-751 package sent

Oct 3 - package delivered

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

Not sure who posted it or where to find it, but I had heard that assests can be listed on a 3 to 1 ratio. Such as $30,000 in assests would count as $10,000 of income. Unfortunately, I'm not to that point in my journey, yet.

I've done so much research and looking here and looking there....it seems after I've given up and post on here someone always knows something. Now that is why I keep coming here.

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

Find it in the I-864 instructions and guidelines, and it's not that simple. The assets must be something that can be turned into cash within 1 year.

Beyond that the use of assets for immigration as described by I-864 does not apply to non-immigrants. The consular officer may go by the same guideline, they may not.

You are going to have to be a lot more specific than "not HUGE" and "moderate". But be aware that even if your were to give every detail just as it will be presented to the consular officer at the interview, no one here can tell you for sure how the consular officer is going to decide.

Hello Yodrak

Its been a long journey and I want to make sure we get this right when I finally get my interview....any help would certainly be appreciated.

It says that my fiance has to give bank records? is that correct? Here all I thought...because he is self employed that he had to give his income tax from last year. He has has stocks and bonds at about 75,000.00...does he have to give the serial numbers and list all investments and how much?

It also says on the form that he has to figure out his net worth.....how does he figure that out? Good grief and we thought we were ahead of the game....lol.

Now is the income based on his gross income or net (farm profit) income??? Gosh just for a minute here I wish I was a tax accountant so I could at least "read" this income tax form. urgghhhh

He can provide whatever financial information he wants to provide, and withhold whatever financial information he wants to withhold. His choice. The consular officer will make a decision based on the information provided and documented. So no, he does not have to provide bank records, but he will want to if he feels that his income alone may be insufficient.

If his investments are all in investment accounts, recent statements of the accounts should be satisfactory. If he's purchased all of the stocks and bonds individually, outside of an investment account, then he will need to identify them all individually.

Your husband, not his farm, will be your sponsor. It is his income from the farm's operation (and other sources, such as those investments), not the farm's income, that is important. Line 22 from a form 1040.

He should be doing this, not you, although you will want to understand enough to try to answer any questions that may be asked about it at the interview.

Thanks for that. Yeah, I know he should be doing it. Unfortunately he is a farmer and it is his busy season....I'm visiting and I have the time to get it all figured out. I'm more apt to notice the little things....

I guess I don't want any errors. We have had a heck of a time with things and soon as things seem to be moving along...well we hit a snag. We have now been "snag free" for awhile (fingers crossed at all times).

I will ask him when he gets back in what all he wants to show. He doesn't have anything to hide and has absolutely fantastic records of everything here.
