Good Morning,

So my Fiance had his interview this morning they told him  that he needed to bring his original birth certificate from Guatemala.  Gave him instructions to drop off his birth certificate at the cargo express with his passport and his visa would be ready in 10 days. Is this an approval? We are still nervous!!!..   I think if they would have denied his visa they would not be making him take additional steps?  Also they did not keep packet 3? .. they just looked at all the things and gave it back to him.. weird.

It's technically a refusal under 221g, which many people call a "soft" refusal because it means they don't have all the information to make a decision on the case yet. Send them the requested documents and they will (once processing it) make a decision. But if that's all they said, then I wouldn't be worried. You should be fine. It will just take some time for them to get and process the documents. It will probably show Administrative Processing in CEAC and you'll see the dates get updated a few various times. If it changes to "ISSUED", then it's approved.

Did they take his passport?

No they did not take his passport.. They told him drop off birth certificate & passport together at cargo express.  I hope everything works out!!.. He is on his way now to CE with originals from Guatemala.  Praying!!

I have read that when missing information is provided to the embassy, the visa procedure will be processed in a normal way. It will just take a little longer.

Good luck!

Okay. Since they asked him to drop off the passport as well, that's a good sign. Good luck!

The same thing happened with me but instead of birth certificate the VO asked me to drop off the UK Police Clearance Certificate along with my passport and after i did that within 7 working days I had my passport with visa in it :) If they reject, they tell you right there. So have patience and wish you all the best :)

Thank you very much!! so they can still reject it is that what you are saying? But I am thinking that since its something like a birth certificate it shouldn't be a big deal.

No they can't reject you on a basis of a birth certificate. So send it off and check your status after 24 hours

Like i said above, the last thing VO asked me is for my UK PCC and said my decision is based on that and gave me back my passport with another letter signed by him on how to apply for a UK PCC. I got scared man, I mean he returned my passport !!! but then i came back home and did apply for UK PCC online and did what the VO said and the day the saw the following status I was sooooooo happy... So all you K-1 visa applicants out there...check your status until you see the this status...
