What address should i put in the i-129f?

Hello everyone,

 

I am really confused about the address to put in i-129f. I am currently in the U.A.E as a tourist preparing to work here for a short time. My fiancée will apply for a k1 visa soon. I don't have an address here, only rent address, and i don't know what address i will be having in the next few months. I will have the interview here in U.A.E and not my home country.

What I have to do?

Are you on a working holiday visa OR a normal tourist visa? Does the tourist visa actually allow you to work? Unless you're living and working there legally, it's very unlikely that you'd be able to interview there.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I will get the work, then i will get the residency of the U.A.E and work permit soon. It is legal work. The company i will work for will handle everything and i will get the work visa. It is legal to get a work as tourist but you'll have to wait to get the work visa, residency, UAE ID to start working.

Hello Benn. 

 

I would rather you wait til your employment is sorted out and you have the actual Emirates ID before you guys file for the K1 Visa. I did mine in UAE too, and they really don't allow people to process K1 visa there or spousal visa if you are not a resident in UAE. Some steps in the process will require you to present your Emirates ID.

 

So wait until your status there changes from tourist to resident and then proceed with filing.

hi benn, so two things:

 

1) i agree with Skywalkers - it is best to wait for your residence visa to be stamped on your passport etc before you proceeding. or wait at least until you know with certainty that your residence paperwork is already being processed by your prospective employer. if you are still actively looking for work at the moment with no job offer in hand, it is a bit risky to bet that you will get a job and all your UAE paperwork will be completed in time for when you have to do your part of the k1 visa process (ie securing documentation and interview). it is also true that the US Embassy will only process your application if you are a UAE resident.

 

2) regarding starting work in the very near future - at the moment the whole process of the k1 visa takes about 6-8 months from submission of I-129f to visa on hand. so you may want to check what penalties you will have to bear should your k1 get approved fast and you need to break your employment contract early. for example, some employers, if you leave your job in less than one year will want you to pay back all the costs they incurred for processing your UAE residence paperwork, some will maybe ask you to pay back 1-2 month's worth of salary.

 

as for your question of what to put in the address...it would be best if your address is somewhat permanent. it's ok if you are just renting but make sure it is at least an address you will stay at during the duration of the k1 visa processing.

I will make sure to get the job soon and prepare for my residence paperwork then we apply. I wanted to save time but it is a little bit risky.

For work now it is new law as i heard i can leave work after 6 months. By that time hopefully i will be ready to join my fiancée.

For the mailing address i will put my home country one because it is permanent and physical address abroad i put the UAE address. right?
