Ukraine girl friend - She has a son- and questions.

Hi there,

 

This is my first post on this forum ever. I have a girl friend now who lives in Ukraine, I live in Pennsylvania. I just got back last week from there and now we are trying to decide on what to do next, the end goal being bringing her here / marriage. We have been discussing options and were looking into a tourist visa for her to visit here and check out my city and see if she likes it, but with the war going on and all, she says getting a tourist (b1b2) visa is next to impossible for her as the US considers women from there a high risk - run for the border case?  So we have pretty much ruled out the tourist visa.  We are trying to not rush into things, but the only thing we seem to be able to do is have me go over and visit her again or have her apply for the K1 visa. So now we are looking into this.  

 

One question is - should I go visit her again over there to make my claim of our relationship more valid for the application? Or is one visit enough?  We spent 6 days together and we are sure this is it. She speaks very good English.  I think I need to go back at least one more time, but she thinks otherwise. Your guys thoughts? 

 

Also, She has a 5 year old boy.  The father has signed a legal paper (I have not seen it) saying he is not the father or something?  The question is, is this a legal document and will it hold up in an interview? Or is there some other form that the father has to sign off on to be able to bring the son over here? What is the process on getting the father to sign off on his son so that I can bring him to the US?

I do not see the harm in applying for a B and absolutely more face time.

I don't agree with the poster above. She didn't say that she doesn't want  the visit. She probably just feels like this is love and that its not required because she is sure. but I think you should definitely see each other again. 6 days isn't enough to get to know someone. I have been with my fiancé 3 years. and I can tell you things change after the first few months.. you get to actually really get to know someone. And each visit is very different. You have to remember no matter what if you bring someone over to USA as a sponsor you are obligated to sponsor them even if there is a divorce from my understanding (until they have a certain amount of working years or something) - maybe research that a bit before you decide.  So my suggestion is to travel both ways each of you before you apply for a visa.(if she cant go to the USA maybe travel to a diff country to meet on vacation) . Also it will be a lot easier for you in the process if you have more visits / proof of relationship.

Also regarding the Father/Son relationship - you will definetly need a lawyer for this one. Taking a child out of country is difficult if the father is involved in the childs life. If he doesn't pay child support than its a different story *not sure what their laws are over there.

Have you already signed the letters of intent? If not, travel at least once more so you can sign them in person (though you do not have to do it in person, original, aka "wet", signature is required). You want to keep seeing each other anyway, right?

 

If your Ukrainian fiance and the kid do not have foreign travel passports, tell them to apply right away. And a good test, of whatever paperwork they have works, may be for them to go out of the country. Go meet in Europe, somewhere, for example, Ukrainians can go visa-free to Europe now.

 

Really hope your case is real. Too many people are being taken advantage of, unfortunately.

It really is difficult to get a travel visa for Ukrainians, especially for women. I know a bunch of girls who didn't get it and then had some problems during the K-1 visa interview. Because there is no way she will get a B visa saying she wants to visit you. so the only way is to lie and therefore she will have problems in future if you decide to get married. But it is always good to try. And I also do agree that she should be happy and excited for the meeting.

 

I don't think she is using you. She just probably doesn't want to spend her time texting on the Internet and finally wants to have a normal relationship. Moreover, if you don't feel like marrying her right now, talk to her about it and take your time. I have known couples who rushed and lived happily with kids or who took their time and got divorced so the time doesn't matter, just follow your heart and again, talk to her about it, no matter what you will decide to do.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I agree with most of the above responses to various degrees.  In my relationship we also started with a six day visit, then she tried twice applying for a tourist visa and even with a good job, property ownership etc., she was denied, so I went back for a visit the following year for a couple of weeks.  We did some traveling in the country, met a lot more of her extended family, and at the end of that trip we decided to do the K1.  This all was after more than a year of Skyping daily, and after two visits.  I went back and met her in Moscow for a third time for the K1 interview after which she was approved (the B1 applications did not harm her as she did not mis-represent herself at those interviews).  

 

I would say, let her try for the visitor visa, but make sure she is truthful at that interview, go and visit her a second time either in Ukraine, or in another country, and continue to grow your relationship via electronic communications.

Well, for now we have decided it is best to go visit her again, so I will be going back in November for a week, as many have stated I should do this and I agree. To the guy who says I am some "homely guy"... I am not. Look at the picture of my profile there, that is me.  I would say we are relatively equal as far as looks go. Neither of us are super models but we look good together which is realistic. So yeah, after I visit her and her family then we will decide for sure if she will come over here.

Enjoy your second visit!  I know with me I took a lot of time to embrace the culture and language during my initial visits and even though I still cannot speak Russian conversationally, I can read it pretty well and after my last trip I can say I really understood what people were saying a lot more.
