I am in the process of filing for AOS and have to answer question 25-27 on form I-485. 

 

I shoplifted in 2012 and was arrested, went to court, pled guilty and ultimately received an absolute discharge.

My court records have been sealed, my record erased from the police network and my criminal background check was clean. I have all court documents, certified translations and proof of the records being erased. 

 

Please proofread my answers and tell me what I should change, grammar, context, details etc. 

 

Q25. Have you EVER been arrested, charged...?

A25. I was arrested on X date and received an absolute discharge on X date. 

 

Q26. Have you EVER committed a crime of any kind..?

I committed the crime of theft in the amount of $104.95 on X date. Please see attached court documents for more details. 

 

Q27. Have you EVER pled guilty or been convicted of a crime..?

A27. I pled guilty for the crime I committed on X date, and received an absolute discharge on X date. My file was closed by the SPVM (Police Service of the City of Montreal) as well as the Municipal Court of the City of Montreal. Please see attached confirmation letters and court documents for more details.

I would suggest don't put the amount, and don't rename the charge in your own words.  Put the official charge as written on the disposition. (Theft Under, Theft Under $1,000, etc.) 

 

It's good you have the court records...can you get a copy of the arrest report as well or has it been purged already?

I hope you ordered more than 1 set of certified documents, because you will need to submit them again later on in your immigration process (even though they will already have it on file from you now).

Add the word "certified" after the word "court" in both statements.  I am assuming your documents are court-sealed and certified...

Get multiple certified copies of the court records you will need it for every step. They will not give them back and will request new ones.

Do you have an idea of how many copies I will need? I'm not in Canada anymore so I will have to request more. Will I need more than one certified copy of the translation as well?

Thank you for your input I was on the fence about putting the amount. 

There is no arrest record that i can get at this point.

Get a letter from the police department of the city you resided in during the time of your arrest.  The police letter should then state that there is no record available (if it has been purged by them).  Make sure you order copies of that letter as well.
