For the past week I have been reading the decisions on the USCIS website.  I see favorable treatment for most appeals.  I recognize that the selection process of who appeals itself   boosts the overall success rate (only meritorious appeal are filed).  The near total  success (Appeal Sustained) does not match the general consensus I read  from VJ Posters who seem to agree that appeals are a waste of time or useless.

 

Am I missing something?

K1 waste of time.  They will just leave it to expire as K1 have an expiration date of 4 months unless it is extended.  They won't extend that for an appreal.

 

CR1 if denied/refused it will be sent back to USCIS and the petitioner will be sent a NOID/NOIR for a chance for rebuttal.

 

Is there a particular visa type you are inquiring about?

K1 and our NOA2 is +204 days due.  USC with several drug convictions (non-AWA and no history violence) that should only result in reporting at Interview.  The delay is making me antsy.

That's most of it, the seemingly endless delay is taking it's toll on our relationship.

 

But your comment about K1 having expiration date of  4 months is that only after approval / NOA2?
