Hi, I hope to find everyone well.  After a few unforeseen delays, we are finally preparing my husband's AOS packet.  I have a few questions and hope someone can help me. 

 

1.  Do we need to send 2 passport pictures total or is it 6 pictures: 2 for the I-485, 2 for the I-765 and 2 for the I-131?

2.  Do we need to complete the G-325A?  I was looking for examples of the cover letter and some have the G-325A listed and some do not which is causing some confusion.  

3.  Is the I-131 Advanced Parolee required?  We are not planning to travel to see his family till late 2018.  

4.  Can the check be sent for the total amount or does the biometrics fee have to paid in a separate check? 

5.  Do we need to send a copy of his birth certificate?  He turned one in when we went to the K1 appointment.  I can not find a clear answer on if we need to send a copy of it as well.

1) Yes, unfortunately.

2) Nop, G-325A is NO longer needed.

3) Not required but just apply for it since the fee would be waived if filed concurrently with the I-485.

4) Total amount is fine. Make sure the check is addressed in USCIS' FULL NAME.

5) Does not look like it is required but double check the I-485 instructions under required documents. CORRECTION: A copy of the birth certificate is REQUIRED per the instructions of USCIS on I-485 instructions sheet.

  1. Yes
  2. The G-325A questions are now incorporated into the I-485. No G-325A is needed with it anymore.
  3. Required? No. But I would still suggest applying for it. Life happens - change of plans, family emergencies, etc. It's better to have it and not need it than to need it and have to wait ~4 months to get it. There's no fee and nothing to lose.
  4. 1 check for I-485 + biometrics
  5. Yes, a copy of the birth certificate is listed as a required document.
    1. From the I-485 Instructions (Page 9):
      "All Form I-485 applicants, except refugees and asylees, must submit a photocopy of their birth certificate issued by the appropriate civil authority from the country of birth."

Yes. 2 photos per packet

No. You do not need that anymore as the recently updated form I-485 already have all the info found in the G-325A form.

AP is optional, you may or may not file it, it is entirely up to you but the actual purpose of AP is for emergency reasons of traveling back to the beneficiary's home country and there is no way we can foresee the events happening in the future. The GC process may take more than a year so to be sure, I would suggest you apply for AP. Afterall, EAP and AP are free if filed concurrently with AOS.

If you are paying via your own check, you can put the entire amount. But for money orders, you do not have a choice but to put $1,000 for the first one and $225 for the 2nd one as money orders have a maximum limit of $1,000 each.

Birth certificate of the petitioner - Yes, they need proof of his US citizenship. That or his US passport.

Birth certificate of the beneficiary - Definitely, since he is the one adjusting status here, he/she has to prove his identity and the info there should match other docs that bear the same details.

Just to echo what others have said, please make sure you just apply for this when you send out the AOS. Have seen too many people on here who didn't apply because they thought they would get the GC in time for their next trip and then things don't quite work out...!

Thank you everyone for the responses.   It helped clarify things, getting the packet finished to send it off this weekend.
