So in short, we had a second request for evidence.  We have until Sept. to send in everything for the RFE.   Before receiving the 2nd RFE, my fiancee realized he forgot to send in the divorce certificate and then sent it in to them.  Then I received our 2nd RFE, which asked for the divorce letter as well as a little more info on things, more clarification that we are in a true relationship, etc... due by Sept. something.  So then today in the mail I receive a letter for notice of action and it says it is an approval notice, and says the above petition has been approved.  But we have not sent in the 2nd RFE information yet, except for the divorce which was mailed a day before we received the 2nd RFE?!  Should I call and ask if they still want me to send in the other info they wanted?  I don't want to mess anything up, we are happy to have received an approval letter but also a little confused.  Could it be a mistake?  Or maybe once they received the divorce letter that was enough?  I did call them about two weeks ago and spoke with someone for more info.  I was on the phone for a long time.  He was able to give me information about my case so I am thinking maybe it was an L2 officer?  Some of the things I had to send in I answered when talking to him and was asking for clarification on how to prove/send something to prove...  So maybe that counted? lol  Sorry if this sounds confusing.  So what do you think?

Well we received the approval letter about 2-3 weeks after receiving the 2nd RFE.  But I think I will call to be safe.  I'm just afraid i will call and then set up a red flag or something and then they will take back the approval.  But likewise, i'm afraid if I dont say anything it could screw things up if they still needed that info from me.   It's exciting but we are afraid to be exited at this moment.  lol

Maybe all they really needed was the divorce decree and once they received it they approved you. You need to call them and ask for a Tier 2 to make sure the approval is correct.

Oh I know, I would be a nervous wreck too if in your shoes.  Better to call though and get it squared away than wonder "what if" ...

Yes I will call for sure.  What do I say though? That I received an approval letter before I sent in my 2nd RFE and want to make sure it is in fact approved?

Personally I'd say something like "Hi , I received my approval letter on ______, and I was calling because I also received an RFE for documents, that I was still getting ready to reply to BEFORE I received my approval letter.  It seems they must have crossed each other in the mail.  Can you confirm that I am approved as noted in my letter and should I just ignore the RFE, if they no longer need the documents requested then?"

 

Depending on his answer---ask for verification of a note made in your file regarding it, confirmation number, or something like that recording that you reached out to them.

Thanks so much!  I will call them tomorrow.  Fingers crossed they don't need more evidence and we are finally approved!!

Just thought of something.  I know you received them a couple of weeks apart...make note of the actual date typed on each letter....not just the dates you physically received them. That would give you a strong indication of whether they did infact cross each other in the mail as I assumed---and you can quote those dates to the L2 officer as well.

 So to follow up on this post.   I did in fact call USCIS, twice.   First time was in the morning, when I spoke with a lower level person who didn't really understand and told me to just go with the acceptance letter because it had a later date.  But also said it showed they received a request for evidence.   

 

So I ended up calling back later and actually got to someone who transferred me to an L2 officer who sounded like he was from Italy.   After waiting 45 min on a call back.   The officer on the phone confirmed that it was indeed approved.  When asked what to do with the current RFE I was working on, ie. Ignore it,  etc... this is what he said: "well, think about it, your visa is approved.  They asked for evidence before this.   Do what you feel is the right thing to do."  After some long pauses and him realised I was really confused, here is what I finally got out of him: "if that we me, I think it wouldn't hurt to send it in."  

 

So in short, I'm still confused but I think I'm going to send in the rest of the RFE just to cover myself.  Though in my acceptance letter it stated that everything was being transferred to the NVC.

Good that you called.  At least you have verbal confirmation of the approval as well as written.  Send it in, it can't hurt at this point, I don't think...would be funny if you got a second approval letter after.
