DCF from London (i130) for Spouse

Hello

 

We are moving to the USA for my job. I am a US-UK dual citizen but wife is just a UK citizen. We live in London and essentially I just want to check timelines and that our lawyer is doing everything right.

 

We initially filed for i130 at the beginning of July. We received our I-797C form with priority date 10th July 2017. However, the address of the service centre is Nebraska - isn't this supposed to be London? We want the fastest process we can possibly get. Just want to check the lawyer has done everything correct.

 

What sort of timeline do you expect us to get from this? I am confused by the i-130 processes on this forum. Sometimes they describe the process from approval of I-130 and sometimes beforehand. Our lawyer has just confused me even further so just want to know roughly when my wife will get her green card.

To use DCF (the fastest filing method available) you need to file directly with the embassy in London. Your lawyer didn't do this, and instead filed in the US which will take far longer (~1 year) to process your wife's case.

As @Hypnos has just said, it sounds like you wanted to file directly with the consulate (DCF) since you have lived in the UK yourself.  Unfortunately this doesn't seem to have translated to your lawyer who has done the filing for you.

The exact same, it will just have the embassy's address on it.

If you are filing through DCFLondon it will move very fast. Since it's now going through the USA it's going to take a while. Probably looking at a year.

 

I did DCF it's pretty simple it you have your ducks in a row. Really no need for a lawyer unless you background issues in your past.

Just to add to what everyone else is saying, looks like your lawyer screwed up. We started our DCF in Mexico without a lawyer around the same time you did and completed the process (attended interview and received visa) last week. Each embassy is different but I would expect that at the very least you would've gotten NOA2 by now.

 

Before we started the process I called several lawyers in the US asking for the absolute quickest route and none suggested DCF. I started researching myself and quickly found Visa Journey and the DCF guide, thankfully. I just don't think many lawyers are aware of DCF.

 

You need to ask your lawyer if you can stop the original application and refile at the London embassy. I personally do not know if this will cause issues, but other VJers might. Continuing the current course will incur a total wait time of 12 - 14 months, more if you get any RFEs.
