Timeline

First time poster, long time lurker.

My wife, (USC) filed a I-485 for me. We used a lawyer and we sent everything correctly. I am in the US now since March, we got married at the start of April and submitted our package with I-485,I-130 and more. We also used her mother as a co-sponsor. I done my medical in April.

So... my timeline is as follows.

JUNE 15 2017 : Everything was received by USCIS
JUNE 23 2017 : Received BIO appointment
JULY 13 2017  : Attended BIO appointment
JULY 13 2017 : Received Request for initial evidence for 1-130A (Dated July 07) / Yellow paper

AUGUST 09 2017  : Response to USCIS request for evidence was received.  Our national benefits center will begin working on your case again (From CaseTracker app - did not receive notice in mail)
AUGUST 14 2017 : Received a purple letter saying that :
The version of the form I-693 is no longer in use....... >>

  • if you receive an interview notice please bring the updated I-693 with you
  • If your case don't require an interview you will receive an RFE

I am going stir crazy not working, does anybody know when I can realistically get my EAD? Is it a good sign I received the purple letter just days after status changed on case tracker?
Money is running pretty low, my lawyer said my EAD would be in by the end of august but now we received RFIE they say it's changed, if I get a job offer can I get it expedited?

Any help would be graciously appreciated.

Dan

EAD and AP are taking close to 4 months currently. The RFIE stopped the clock (or "reset" it according to some others) until they received the response. I have no idea where your lawyer got his timelines from as it hasn't been that quick in quite a while now.

Yes they told me 75 - 90 days for EAD and After 75 days I can put in a service request.

Is it reset or was it just suspended? I can't actually get a real answer on it.

Well it's currently taking 3-4 months on average, and edging up towards 4 months as the backlog doesn't seem to be subsiding still. Hopefully it's closer to 3 months for you.

Yes, at 75 days you can submit a service request. However, getting an RFIE does reset this clock for when you can submit the service request.

As for whether it actually "resets" where you are in line / when your case will be processed, I don't think that's actually the case but I don't have a confirmed answer on either side of the issue. Sorry.
