hi vj family I need help with my concerns. my partner and I had  an Islamic wedlock since 2012.we met in 2011,now he  wants to file for da fiancé petition.though da marriage is not legal according to the  laws of Ghana since it hasn't been formerly registered.howvere am concerned dis may be an issue,pls anyone with advice shoud kindly assist

There have been a lot of problems with this for others.

 

Too married for the K-1 but not married enough for the CR-1.

 

Thought about getting married again and filed for the CR-1 visa?

I assume you had a nikah ceremony?  The USA will most likely consider you "too married" for a K1 fiance visa...

A K-1 is probably not the right route for you. Your better bet is to register a civil marriage with the local authority and then file for a US spousal visa instead.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I highly, highly advice against doing the K1. The Ghana embassy is very tough...even with some positive changes that appear to be happening there.

 

If there is any indication you have done something that appears to be a wedding...like a traditional engagement party or wedlock...you will likely be denied because they will view you as married. It doesn't matter if it's registered or not.

 

My husband and I's K1 was denied because he took photos from a party his family threw for us. We were not married, there was no ceremony, no rings or vows exchanged...just food and matching outfits...but they denied us because they viewed it as a wedding.

 

Please learn from ours and many others mistake and don't attempt a K1. You should go to Ghana, get married there and do a CR1. I know it will take longer, but it will save you heartache down the road.
