Hello everyone,

 

I was hoping to get some feedback of probability of my girlfriend getting approved for a tourist visa.

 

I went to Brazil in July for two week to visit her family and we are hoping she could visit here during her college vacation in December. The intent of this trip was to spend more time and for her to get a better view of life in the U.S before jumping into the K1 process.

 

-Her dad is little to harsh about her coming here with even the tourist visa; he wouldn't let us stay at a hotel far from home nor let us sleep together. He likes me but very protective. The point here is that we don't have family support to consider applying  for the K1 visa.

 

- some details about her that may stand out: going to college, paying a loan and works as a babysitter. She has her vacation in December. No assets such as a car.

 

- I am anticipating that I will be in Los Angeles Polce Academy in January timeframe and with that being said, it will be awhile (1 year or so) before I could go visit her again. Also I have my monthly (2-3 days a month) military obligations.

 

 

Are we better off just applying for the K1? I want to be honest about our intentions for her visit in December and at the same time I don't want to damage my relations to her family if she chose to come here through the K1 without their support. Anything advice?

Would her father be happier if you married in Brazil?

Unfortunately no, she had a boyfriend of 4 years (age 17 thru 21) and her dad would not let them sleep and had to have the bedroom door open at all times.

She's got a fairly slim chance. Her only strong tie to Brazil would be school. Paying a loan, well some people would just up and default so that's not a strong tie. Working as a babysitter doesn't sound like a permanent job with bright future so not a strong tie either.

 

On the other hand, a K-1 is for people who completely intend to marry each other. It's not for her to come "get a feel of the US to see if she likes it and how's life like in the US".

 

You're better off to just meet in Brazil or a third country. If you have plans to file a I-129F in the future, make sure to gather evidence from each meeting. They are important and must be included in the petition.

Thank you for the input. just to clarify that the tourist visa was for her to visit my family,spend time and understand how life works here, not the K1.

Yeap, got that :) Just didn't want you to think that K-1 is a substitute if she didn't get a B2. Either way, I hope things work out for you and your gf!

I understand that her family support isn't required for the K1. I was trying to see if that was one justified statement  for her to come thru the tourist visa.

Sounds unlikely her family are going to OK with her visiting.

If she is in college, then it does not seem like the right time for a K1. Add that to the fact that you will be in police academy for a year, you too will focus on your career. 

 

If she is doing well in college, she might get the visitor visa. She should take an enrollment letter and a transcript.

 

As for the dad, he is just being protective. He probably does not want her to get pregnant or to get hurt. Even though you don't need support for the K1 from her family, you don't want to get her into a mess with her family. If she moved to the US, she would not see them frequently and families in Latin America are much closer than in the US. So either way, it is better to get her family on board to whatever you decide. Also, you should consider that a spousal visa is much cheaper and she gets a green card when she gets into the US, so maybe eventually marrying in Brazil would be a better option.

 

That said, for either visa you need to put together evidence that you've spent time together. So she should apply for the visitor visa and try to visit during her summer vacation.

If she were to apply for the B1 how would she finance the trip?  Visitor visas are all about the visitor, so as others have stated, if she applies, she has to show strong ties to Brazil to convince a consulate that she does not intend to stay, and in general, having a significant other finance the trip is frowned upon as an enticement to attempt to stay permanently.

 

Regardless, hopefully you both work through the peripheral issues with your families if you do intend to stay together.  How does her mother feel about the relationship?

It's really only her dad in regards of visiting; I didn't go into full detail because it wasn't necessary for the question.

 

He said as long as she lived in the house, he wouldn't let her visit.

So She is moving to the front house with her brother and I'm helping her cost of food(it's doesn't cost much). That's the only difference if she moved out.

Thanks for your input. I fully understand, I was just seeing if we could see each other again before we focused on our career. I told her she should finish school first while I complete!my academy + probation time. I have all our stuff saved and documented, I'm not in a rush to marry.

Thank you very much, I wasn't aware about who was paying for the trip factor.

 

Unfortunately, she passed away when she was young.
