yeah I will give this week then we will see what's gonna happen, they shouldn't reject it cause my wife's visa is ready and my son is only 2 months old, we can't leave him behind.

Immigrant visa is good for 6 months, hopefully it will not be that long.

But I dont think 6 months would be enough for another petition. They should seriously consider processing my son I130 in Embassy because my son eligible for that under USCIS memorandum policy.

I said earlier that I thought it would likely be approved, but it is not at the discretion of the Embassy.  Whether it will be approved for the Embassy to accept the petition for processing will be a USCIS decision at the regional office.  You should be ready with all the required documents to make the rest of the process go as quickly as possible (the I-130, baby's birth certificate and passport, etc.).

I get what you saying. His I130 is ready and Embassy has my son civil documents and I have already fill his DS-260 out. I hope they accept his petition in Embassy.

My wife case stays the same but my son case updated today, Do you think they working on it?

Possibly.  At least that they are working with USCIS to get your request to file the I-130 processed.  Until that is done, they don't have a case for your son to work on.

They are keep telling me the same thing to file in USA. I am keep telling them to Talk to regional office in New Dehli to make a request and they keep telling me to file over there, Stupid AF. I am telling them that First you gotta listen to me what I have to say then you can email me. Damn they are stupid AF.  Now I gotta talk to my congressman cause these people dont understand whats going on here.

Who is "they" and AF?

 

Did you make a formal, written request to file the I-130 at the Embassy in Islamabad, with evidence to support the reason for your request?

The people who work in embassy. they dont even know how this USCIS thing work. keep sending me the same message to apply in USA. anyway I just talked to congressman and he just sent out the message to Embassy.

And you didn't answer really we he there you filed a firmal request or not?

I did make a formal request. I told them to Make a request to USCIS under memorandum policy so that my son petition can be process in Embassy.
