Ok, im still in England, with my K-1 visa interview next week. If all goes well ill be going to the USA, getting married and filing an AOS.

Now, my fiance is currently working , but is planning to go back to college this next semester.

She lives now with her parents, and so will I. Her dad (my future father in law) Has agreed to co-sponser me as my fiance dosnt have enough income.

Now, we are planning to move from south dakota (where she currently lives) to minnesota to go to college, in June, while my AOS is still being processed. But, I read a co-sponser is only allowed if they are of the same house hold as the petitioner.

SO, Me and my fiance will be living with her dad (the co sponser) when we file the petition in may, but in June are planning to move away to go to college.

So, what I want to know is, when we file for the AOS and her dad co-sponsers us, will it still be valid after we have moved to minnesota? Will he still be allowed to be our sponser even if we have moved after filing and he isnt part of our household?

Sorry if ive made this too long or un-clear but, if my future father in laws sponssership of me is subject to us living with him untill I get the greencard, we will put off going to college.

Note that there are 2 types of 'co-sponsor' with regard to I-864 - there are Joint Sponsors and there are Household Members.

Read the I-864 instructions to determine which might be the best way for you to treat your future father-in-law.

I dont entirely get it. It says a joint sponser must be "living in your residence" and right now , and at the time of filing, we will be. I didnt know there were two different types of sponser, now im confused. I was under the assuption he would fill out i-864a . Would he file a i-864 instead?

For AOS and the I-864 the Joint Sponsor can be anyone willing, and do not need to be a member of the same house hold, the Joint sponsor will file an I-864 as well as the primary sponsor.

This is different that the Contract Between Sponsor and Household Member (I-864A)

Form I-864A, Contract Between Sponsor and Household Member, is an attachment to Form I-864, Affidavit of Support Under Section 213A of the Immigration and Nationality Act. It is an optional form, completed and signed by two individuals: a sponsor who is completing Form I-864, and a household member who is promising to make his or her income and/or assets available to the sponsor to help support the sponsored immigrant(s). The combined signing of this form constitutes an agreement that the household member is responsible along with the sponsor for the support of the individual(s) named in this form.

If the person who is seeking the immigration of one or more of his or her relatives cannot meet the income requirements, a"joint sponsor" who can meet the requirements may submit a Form I-864 to sponsor all or some of the family members. A joint sponsor can be any U.S. citizen, U.S. national, or lawful permanent resident who is at least 18 years old, domiciled in the United States, or its territories or possessions,and willing to be held jointly liable with the petitioner for the support of the intending immigrant. A joint sponsor does not have to be related to the petitioning sponsor or the intending immigrant.
