Timeline

  I am bringing my parents (mom and dad) here i130 is  approved .I am the only who work we file jointly on my tax i have my wife two daughters and my inlaws.in 2015 my income was 42,672. i am going to file tax for 2016 this week cuz i got extention ,now i am thinking if i don't claim my inlaws to last year tax return is my income is be ok for my parents , then my family be myself ,wife and two daughters. Do i still need a joint sponsor .last year my gross income was 45000. Thanks for help .

how are you able to claim them as dependents if they are not in the us? there is a substantial presence test for not residents to be claimed on taxes. the required incone for 6 people is at least $41200.  to be able to claim the inlaws as dependents they have to make less than 4500 I think.

 

it is going to be very hard to care for them when you make do little money. they will not be eligible for Medicare so they e ill have to pay out of pocket for things or get an expensive high deductible plan. I strongly recommend you look at all the costs involved for when they are here to see if you can manage it. also people will get sick so planning on perfect health is going to hurt you bad.

He claims his inlaws and is petitioning his parents. Not the same people.

Hi Kgill, if you choose to NOT claim your in-laws on your taxes, and your family will be yourself, wife and 2 kids, this means you will need to claim 4+1 as the household = 5.

 

Based on the 2017 poverty guidelines, found here https://www.uscis.gov/sites/default/files/files/form/i-864p.pdf you would need to make at least $35,975.

 

So as you are making $45,000 (as shown on your tax returns) then you are over the minimum, and are good to go, NO need for a joint sponsor.

11/18/16... Checks cashed, received emails and text messages at 5:22pm, cases routed to Texas Service Center

02/22/17... NOA2 for Mom received (Notice Date 02/15/17)

02/28/17... NOA2 for Dad received (Notice Date 02/17/17)

03/01/17... Status online shows application sent to NVC 

03/17/17... Received emails from NVC for next steps!

03/21/17... Went online to Choose an Agent

03/28/17... Received emails from NVC confirming Agent selection and to proceed with the next step (paying fees!)

04/05/17... Paid the $120 Immigrant Visa Application Processing Fee online today (Also eligible to pay the $325 Fee but will wait before doing so...)

April-August... Took a break from the process in order to move back from USVI to mainland USA.

08/07/17... Paid the IV Fees for both my parents ($325 each) today

08/23/17... Called NVC because payment still showing "In Process", was advised to email proof of payment to have them manually correct it

08/24/17... CEAC website shows "Paid" and can now have parents' DS-260 forms filled in.
