HI, 

      I 130 is approved for my parents and i have a question about i864 i have a five depended on tax return my wife she is not working we file jointly tax, two kids and my in-laws .I file i130 for my parents and got approved . I just want to know how much income i need in i864 .My income is 42,674 is that is ok to approved visa for my parents (mom and dad). Thank you

Doesn't look like your income is enough to cover everyone based on the guideline :( Perhaps get a joint sponsor.

you barely make it, you should have a joint sponsor lined up just in case the officer decides you need a joint sponsor

 

if you check the poverty guidelines, for this year, it is $41,200 for 6 people

If you're applying for both parents then your family size is 7 (5+2 parents). One of your parents would need a joint sponsor, or you could submit evidence of additional financial assets (bank accounts, net value of your home etc.).

then something doesn't add up, first he says five dependents

 

then he says, himself, his wife 2 kids and the in laws? is there a kid missing?

 

or is it 5 + himself would be 6 not seven

Just speaking from personal experience, if I have two people in front of me in the visa window I count both as members of the household. Thus 7. Though reading the OP again, it sounds like he is saying he has 5 dependents. Thus would 1+5+2 parents=8. 

 

Agree that they are separate petitions, but I would still refuse one of the parents public charge and tell the family to get a sponsor. We don't have much discretion in reviewing affidavits of support but there is some room to apply common sense.

Thanks for the help,   I don't have anyone to help me with joint  sponsor. I did not file last year tax cuz i got extention ,now i am thinking if i don't claim my inlaws to last year tax return is my income is be ok for my parents , then my family be myself ,wife and two daughters. Do i still need a joint sponsor .last year my gross income was 45000. Thanks for help .
