Hi guys need help:cry: I applied i130 last January 2017 a NVC received it already.. now we got an email that they will interview me from my home country once we completed the steps of application.. my problem is I am here in the US with my husband will that be mean that we had a mistake filing it? And now I realized I have to file i485 at the same time I am filing i130, will it be problem if we will file now i485? I am so confused now what to do :( please somebody help me

how did you enter the country? did you enter legally and overstay? what is your current situation

 

if you entered legally, then yes, you should have done concurrent filing and adjust status in the US.

 

now you will need to notify NVC that you will be adjusting status in the US if you qualify and send the adjustment of status packet with the copy of the approved i130

 

you don't mention how you entered the country and why you believe you qualify for concurrent filing.

Hi thank u for ur reply.. yes I actually entered as a tourist visa and no intent of getting married here as me and my husband doesn't know each other yet before I come here.. really I don't know what to do and I have read lots of forums that it's red flag 😓.. really I don't have any intention of staying here but because I found my love here I stayed and my husband filled i130 .. now when we received yesterday the letter from nvc we are shocked that it says I will be interview in my home country.. how can we adjust that? Please help

hi

 

there is no problem in adjusting status in the US if you didn't intend to do so and lied to the officer when you went through customs

 

a person only sends the i130 when they are going through consular processing, so now you need to send the rest of the adjustment of status packet together with the approved copy of the i130, always make copies of everything before sending

 

did you send the i130A with the i130? if not you will need the i13oA, i485, i864, i693 medical exam and vaccinations and the i131 travel document if you want to travel
