Sponsoring Mom for a Green Card, Any advise appreciated

Hey peeps :) wow it's been long time.

 

So Here is my question. I would like to bring my mom to US, bring her as in getting her a Green Card. She does currently have a tourist visa (B1), probably expiring around 2025.

 

Long story short after my dad passed away, we figure there's no need for her to be in Istanbul living by herself, also We just had a baby girl :). I rather my mom look after her than some 15 year old girl.

Regardless of this she needs to be here and not living alone; how do I go about bringing her here? She's actually coming in the next 3 weeks because wife will start working then.

 

Can you guys tell me how the process for this; I adjusted from F1, so I did I-130 then I-485. Is this the same process? or different? We sent my I-130 and I-485 altogether, is it the same here?

You will file I-130 for her and can review the guides here ->http://www.visajourney.com/content/immigration-parents-overview and here ->   http://www.visajourney.com/content/immigration-parents.

 

The process should take about a year. You mother will be able to continue visiting during that time.

 

You should be aware that babysitting while she is here on a tourist visa is not allowed because it is considered work. In the eyes of the government that 15 year old US citizen girl has priority over your mother. So be careful.

Priority Date: July 24, 2007 (EAC)

AOS fee paid: February 2013

Request embassy change: May 2013

Son born: September 2013 (added to petition March 2014)

Interview: March 17, 2015 (Joint sponsor needed)

Joint sponsor documents submitted: April 27, 2015

Visas approved and issued: April 30, 2015. Had to return to embassy to do oath for son :)

Visa in hand: May 5, 2015 (two working days after issued)

IV fees paid: August 10, 2015

POE: JFK - September 10, 2015 (one day before visa expiry date - No hassle)

Returned to Barbados: September 28, 2015

Green cards: October 5, 2015 :dancing:

Entered US permanently: March 22, 2016

Applied for SSNs: March 28, 2016 (didn't tick box on DS-260)

SSN received: April 4, 2016;

Learner's permit: April 7, 2016 (in NY you also have to do 5-hour class);

Driver's License: July 13, 2016 (on first try) :dancing:

Husband's Journey (F2A)

Married: September 2015

I-130 sent: October 8, 2015 (via USPS)

Priority date: October 9, 2015 (WAC)

Petition approved: March 8, 2016 (5 months to the date of receipt) :)

NVC Welcome Letter: May 13, 2016
AOS documents sent: August 8, 2016
Case complete: September 14, 2016 (the waiting continues:clock:).

Interview:  October 5, 2017 (Approved - Issued following day :))

Visa in hand:  October 12, 2017

POE:  October 13, 2017

No. Filing the I-485 would be to adjust her status while she is in the US. Entering the US with the intent to adjust status would be fraud. She needs to return home by the end of her legal stay, and interview abroad.

Before you do anything work out how you will afford her medical expense, sounds like she is not in the best of health.

You would also need to be a US citizen before being able to petition for your mother.

in the i-485 form what is this

 

"Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?"

 

do we say yes or no?
