I am a Filipina and I just got the court's decision for my annulment but there's no declaration of finality yet which is another piece of paper.

Question: when filing the  I129 form with the USCIS is the proof of annulment - declaration of finality and/or Certificate of No marriage, necessary? I mean at the Application stage with the USCIS, or are these documents necessary during the visa interview at the embassy?

Declaration of finality is important at the I-129F stage to show that you are free to marry. For the K-1 stage, you'll need the CENOMAR and probably a copy of the declaration of finality.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

4. Termination of Previous Marriages If either you or your beneficiary were married before, submit evidence that all previous marriages were legally terminated. Evidence of termination of previous marriages may include a divorce decree, annulment, or death certificate issued by a civil authority.

 

Above is per the I-129F instructions documents that are required.

Thank you all for your answers. This is so nerve wracking given the fact of the slow process of annulment here in the Philippines. I went to court at first and it said the decision isnout and it's ready for printing, a week after I went back to make a follow up, it is still ready for printing. I'm just so worried with the timeline coz my daughter is turning 21 on April 2 2018 and I'm afraid we couldn't include her in the Application as one of my dependents/children.
