Yes my lawyer filed the K3 and I questioned him after I had seen places like Rapid Visa change the K3 on their web site to the CT1/IRI. I don't have much faith in my lawyer now but if already paid him over $3500 so he better get on the ball cos people on here seem to know more then my lawyer..

Ah, then expect about 7+ months. When the I-129F reaches NVC, expect it to be administratively closed (unless the I-130 is adjudicated first, then USCIS will close it). The I-130 will continue and you can do a CR-1/IR-1. But the ~4 month timeline won't apply here.

Timelines:

ROC:

Thank you for your reply. It's been since Nov 2016 when lawyer filed 1-130 and Dec 2016 when lawyer filed for the K3 visa. I told my lawyer to file fastest way for my husband and it seems now that my husband will be delayed even more since he filed incorrectly. This makes me more upset.

It shouldn't slow down things really...the I-130 should be processed is the same general timeframe. I'm sorry you're past the average timeframe...it is something that just happens unfortunately. It's not a sign of anything being wrong at least.

Yes very frustrating when you know other cases are getting approved and ours are sitting untouched. Just not fair....

The bad is when I inquire I'm told by USCIS that I'm in the timeframe. They are truly understaffed and very insensitive.

The processing dates on the USCIS website are always a few months behind. For example, they are showing times as of June 1, 2017 for AOS. Well, it isn't June and therefore that data means nothing to me. Check the USCIS "updated as of" date. It will likely be the same.

Personally, I find the visa journey timeline to be more accurate 1) because it's more current 2) because it's based on live data from VJ'ers who are updating their timeline often as we speak.

If I were you, I wouldn't even bother with the USCIS one. The estimates you VJ timeline provides you with, too, is often very reliable.

Good luck with your K1!

Jan 17th NOA1 and still waiting for a NOA2 with no RFE or security holds yet. 2 Inquiries and same generic answer that my case is in line to be processed we process in the order they are received.. which we all know is false. Most take about 4 months and every once in awhile you get an unfortunate case like mine and others here.
