It sounds like they will require some additional paperwork before they can process your case. This is what here on VisaJourney is referred to as an RFE. It could be something innocuous as you forgot to sign a form, or they may request additional evidence to demonstrate that your marriage is bonafide. What did you send to demonstrate a bonafide marriage?

 

In any case, speculating about what they may have asked for isn't really worth the worry. You'll need to wait for the letter and then respond to the specifics they ask for.

 

 

Ok, I will sit tight! We only sent through proof of marriage.

Hi all,

 

Hoping someone can shed some light on our situation.....

 

First of all, USCIS have notified us that they received our documentation to support the 'request for further information' - This was on December 15th. Any ideas how long it takes to get either an approval or another request for further information ?

 

Secondly, I am now in the states (legally) on a Visa ESTA (90 days) but as we filed for partition I-130 (outside the United States) I am assuming that at the end of my 90 days I will have to leave the country then either re-enter on my new green-card (wishful thinking) or enter on another 90 days Visa ESTA. So I can see a few different cases which would allow me to stay in the United States on this ESTA but as I filed from outside the United States, I imagine this would be a nightmare. I have tried reaching out to a field office but all 9 I checked (across 3 states) default to 'no appointments available' check again tomorrow.

 

Any help on this would be greatly appreciated.

Just want to update you with my progress...

 

Today I received form I-797 (I-130 NOA2) - Application approved! Off to the NVC for me :)

So I have a 3 month visa ETSA but I am going back to Australia in 2 weeks for 3 months to contract. So I will have approx. 2 months left on my ESTA which I can use to return to America if needed. Otherwise I will have my green card ready to immigrate since it will be around April :)

Hi all,

 

I am waiting to hear from the NVC saying that they received my case from USCIS (I received form I-767 approval on 29th December from USCIS).

 

Can someone explain what to expect from after the interview, I am struggling to find a straight answer ?

 

Seems like they can approve on the spot or request to leave all documents with them then they will send the 12 month visa stamp with the rest of the paperwork in the mail. If i have to wait, any ideas how long ? ( I know the maximum is generally 6 months)

 

Does my green card come with a social security ID so I can find work right away or once in America do I think have to apply for that and in the meantime not work ?
