Hi,

 

I'm currently living with my boyfriend here in USA and we are in the midst of filing the K1 form while I'm still here. We will be going back together in my home country by the end of Sept and I will stay at my home country while waiting for my K1 visa. My question here are

 

1) Can we submit the paperwork before we both fly back to my home country? (My current visa is B1/B2 visa) OR do I have to wait until I'm at outside of USA then only he submit it? We are planning to submit the paperwork before the end of this month (Aug) 

 

2) We are not officially engaged yet (he haven't actually officially proposed me) and he's planning to do it soon before we fly back home together and wanting it to be a special and surprise so at this point I have no idea when he actually will do it. My plan was to do the paperwork a.s.a.p , but I was wondering do we really have to be officially engaged and have a ring (for pictures, and etc) to apply for this?

1. Yes, the I-129F can be submitted while you are in the country on the B1/B2 visa

 

2. You don't need to have a ring to be engaged. I didn't include any information about my engagement ring, or photos of engagement in my I-129F packet. You do need to provide letters of intent to marry however (each of you needs to write and sign a separate one). If you both agree that you want to get married and are committed to that, then in a way you are 'engaged'.

1. I would prefer to send in the package when you're together in the US, that way both of you know exactly what is in the package and you can add your wet signatures on everything even if it's not needed for the beneficiary. We did it that way, no reason to wait until you leave the country.

2. As long as you intend to marry each other within 90 days of you arriving in the US on your K-1, you're good to go. A proposal or ring isn't necessary at all. Two people who have agreed to marry each other are engaged, no matter if there's an official proposal or not.
