My dad got divorced in the year 1993 and remarried in 1995 and then in 2003 my Aunt (dad's sister) filed a petition for calling Dad to USA along with his family. 

At present we have even paid the Visa Fees. We have even submitted the required documents at the NVC.

 

But later we were asked for the Divorce Decree to be submitted to them. But the thing is the Divorce took place by signature of both the parties and witnesses on a legal stamp paper in front of a notary and this document becomes a formal divorce document and is almost considered as a Divorce Deed in India. This DEED OF DIVORCE  was notorized and was also registered with the Sub-registrar.

And based on this document, people even remarry and such marriage is totally legal in India as well as per Hindu Customs and Traditions and the same is in case of my dad.

 

Now even if we apply to the court for the Divorce Decree it will take considerable amount of time. 

 

Can someone having knowledge about the same or has experienced such issue, please help out because my parents are very tensed about this.
