Hello There,

 

I needed some clarifications on the question - Information about beneficiary's family on i130

 

Background information - My mom and dad have been married only once and still in the same marriage, they have 2 kids, me (USC over 21) and another son (over 21 - not intended to immigrate )

 

On the question Information about Beneficiary's family - 25a and over, who all do I have to list.

 

Ques 1 - Since i'm filing 2 separate i130 for mom and another for dad - Do I list spouses separately on their individual i130s (eg mom as spouse on dad's i130, and dad as spouse on mom's i130)

Ques 2 - Do I have to list down my name on the Information about the beneficiary's spouse and children (I am already a USC and Petioner)

Ques 3 - Do i have to list my brother (over 21, and does not wants to immigrate to US) on this section

Ques 4 - I believe my wife and kids are out of topic of this discussion but confirming just in case.

We are going parallel in trying to fill these forms in :) I did some research on these questions as well. As with the previous post, I hope someone with experience responds, but from the research I have done, here is what I am planning to do. In answering as indicated below, the premise is: if we enter the names, there is no harm done, but not entering the names might lead to mis-representation??? I wish there were better instructions - INA law defines child as under 21...but then the form says "Provide information about beneficiary's spouse and children". There are no special instructions given, so we are assuming ALL children irrespective of age.

 

Ques 1: Mom as spouse on Dad's I-130, Dad as spouse on Mom's I-130

Ques 2: Listing myself as a child (I am also USC and over 21) --- but again, I am still their child although I don't fit the INA definition of children

Ques 3: Listing my brother (who is also over 21 and does not want to immigrate to US)

Ques 4: I don't believe you need to enter any information about your wife and children here...this is information about "beneficiary's spouse and children"

Yes, that is what I thought so too. and our profile and timeline very well match 

 

for eg

- you are filing for both of your parents - so am I

- You are the USC son and have another sibling (over 21) who does not intend to immigrate to the US - So in my case

- Mother's name issue - My mom has used a different form of name (differrent spelling) on some documents  - I believe same the case in yours

- parent's birth certificate issue - My parents don't have their birth certificate too - we need to figure out what to do

So, I sent in the two I-130s this afternoon. Now the wait starts. Will also work on getting the "birth" documents ready in the meantime. We have school leaving certificate for mom, but that has her maiden name and birth date on it, not her parent's names. Now what? Also, will have to apply for dad's school leaving certificate as that is not available. Anyone who has experience using school leaving certificates in lieu of birth certificates? Mom is 75 and dad is 79, no immediate older relatives alive as far as I know...so affidavits seem difficult to get. But who knows, maybe their cousins can affirm the affidavits. We will have to see.
