Im so sad. My interview not successful

I feel so stressed and sad right now. :crying: I had my K3 visa interview yesterday. I have prayed a lot and received good luck from my friends and also here from visajourney. But still the CO didnt give me a visa. I thought I already have completed documents they needed. Ok, here it goes... I was really damn nervous before talking to the CO. he was nice though, first he asked me few questions about my relationship with my husband. and I able to answered it well.Then CO checked my husband's mom affidavit of support since my husband still in school right now and will graduate in august. (He used to have a part time job as a math tutor in his university). But CO told me that $30k income is not enough to support me since they already 4 in the family. The father doesnt work but he's receiving pensions. (They didnt include it from the support) The CO thought I could be a burden when I go the states. I felt rattled already and wasnt able to answer all his questions well. I kept insisting that they even have a paid property, but CO said as if my husband's family will going to sell their property for me... I even told that my husband will graduate soon and will have a better job and I will also planning to work and will able to support them as well. What a bit odd in his question for me is like, do u have money right now?! Of course I told the truth, though i have but still not enough. Is this part of the requirements that I should have tons of money here in P.I?! well, well, the CO gave the white form and adviced me to wait for my husband to have a job, they returned my passport anyway :( My I-129F petition still with the US embassy, they say I could present my husband contract of employment or payslips once he will landed a job. But I know it will take a lil more while. another timeline for me...

Right now, we are processing my I130 petition. It was approved in december. My husband's family is planning to find a good lawyer to help our case. This time, they are going to include cousins good income who is really willing to help.

You know what guys Im not really eager to go to the U.S. as soon as possible. All i want is to be with my husband.I have suffered a lot not seeing my husband. This feeling really hurts me a lot. Really!!!

Any suggestion about me case?! It was really a painful experience

:( Sorry to hear about your interview I figured it out total shy is $3.14 a week, his father should have sent in a support affidavit also with his pension statement, that would have put him over the cut off for 2007 which is $30,163.00 125%. Now I can also see that sometimes families have a following out, which would put you two between a rock and hard place. A part time job of 20 hours a week may be acceptable.

Hi guys,

I am so sorry to hear that news...i too am worried about my fiance's income that's why i dont expect much..we just present whatever is the truth and let it be....lift everything to God...it is harder for us since co-sponsorship is not acceptable for K1 visa....

got so interested though when Consul asked you if you have money now...i was already thinking to ready my savings/time deposit accounts to show that i had savings being a manager in a firm...ill convince the Consul too that with my work experience here in the phils. and being a CPA here, i wont be a burden for the family (most likely) but might even have better opportunity once i can work legally.

Thank you friend!!! :) I feel better now. My husbad will have an appointment on thursday with Mr. Michael Gurfinkel. I hope the this lawyer could help us how to sort this things out! :)

What makes you think co-sponsorship is not acceptable for K-1? It most certainly is. The Manila consulate is very strict (to the point some believe Manila won't accept co-sponsors) and if your co-sponsor is not a close relative of your fiance you may have a tough time getting the CO to buy it. If your fiance's income does not exceed poverty guidelines YOU NEED TO FIND A CO-SPONSOR! Don't walk in with inssufficient income and just hope for the best or you will be disapointed for sure. Why wasn't your father-in-law's pension included as support? Would they not allow it as income? That would have probably put you over the minimum income allowance.

I just looked at the 2007 guidelines and it says for a family of 5, the minimum is $30,162. Is this not correct? Or being $162 under can keep them from approving the visa?

Yeah,

would it not be enough to show to the CO that you have $162*5 (years) = $810 in savings, to make the limit?!

I mean you surely have that much, or could borrow that much for a few months?

Or the minimum numbers are only guidelines and it's up to the CO to decide what is sufficient and what is not?

they did not refuse you, they only asked for better evidence that you will not become a public liability. It is really not that bad (although annoying and depressing, understandably).

I am new to this forum and I am not very knowledgable about the laws although I understand that the US does not want anyone who immigrates to become a financial burden. It looks like you have received some good advice from the others, and possibly using the cousin's income, or any other ways to show a higher level of income will help your case.

I just wanted to let you know that I understand your feelings of sadness at being separated from your husband. It is one of the most difficult issues; worse than dealing with the endless paperwork, lawyers, the fears. I hope that you are feeling even a little bit better and that you will be able to get through this difficult time with faith and courage.

yes it really is!!! but i feel bit better now! i am planning to go back to the embassy next month and submit my hubby's cousin affidavit of support, his moms and his as well. I really hope they will consider this time.. yay

I am new to this forum and I am not very knowledgable about the laws although I understand that the US does not want anyone who immigrates to become a financial burden. It looks like you have received some good advice from the others, and possibly using the cousin's income, or any other ways to show a higher level of income will help your case.

I just wanted to let you know that I understand your feelings of sadness at being separated from your husband. This was your response in your previous post. If he's not working and still in school, scheduled to graduate soon, how can he make this amount? I'm confused.
