I am Chinese, My husband is US citizen. We don't have kids, and we live with his parents in his parents' house. So the supporting document list as below:

  • copy of marriage certificate
  • copy of green card
  • copy of joined tax return in the past three years (2016,2015,2014)
  • copy of statement from GEICO that shown I am "listed as drivers and/or named insureds for the referenced policy". Is this ok??
  • Notarized letter statement from my mother in law. it states that we have been living together since 2014
  • some vacation pictures
  • two affidavits letters from our friends.

Is there anything I missed? Please let me what should I add to my list. I will be really appreciated.

Thank you!!

Thank you!!

-Submit tax transcripts instead of tax returns, you can order them online and get them in e-format right away and print them

-Do you each have a will naming each other as beneficiary?

-Joint health insurance policies?

-Life insurance policies naming each other as beneficiary?

-Do your state IDs/driver's licenses both show the same address? If so you can include a photocopy of both of those

-Are you on his parents' phone plan or do you have your own? If your own then include a copy of the plan showing you both on it. If on his parents you should still be able to print something showing you're both on it

-You live with his parents but do you pay them any rent, pay part of the utility bills, etc.? If you pay them anything you can download a basic rent receipt/expense receipt template and fill out one for each month that you've lived there and the amount you paid them for that month and have his parents sign each one. Make sure you put both of your names on there.

-Joint bank account statements?

-Joint credit card statements and photocopies of the front and backs of the credit cards showing the same credit card number on both cards?

-You mentioned vacation pictures, do you have any copies of hotel bills or boarding passes from those trips showing you both stayed in the same room, both were on the same flights, etc.?

Just a few examples to start with.

thank you for your reply.

We don't have will and life insurance now. But we do have joint health insurance.

few questions.

1. We have a family plan together through Cricket . I am the account holder. But when I tried to print out the statement, it only shows our phone numbers. There is no name on the statement at all. I don't know whether this one still count.

2. We pay the utility bills for the house. The account is under my husband's mom's name, we just pay the bill through her log in. I definitely can print out the statements of each month and let them sign their name.(the last 3 months is enough?) My concern is that my name is not on it. I don't know how to fix this

3. I will let my mother in law write the notarized letter to state that we live there since 2014, and we pay for utility bill for the house. Do this help question 2 a little bit?

Thank you again.

It's pretty easy to draw up even a simple will and it's a strong piece of evidence in their eyes. You could even use one of the inexpensive willmaker software programs, it takes care of all the "official" language for you and walks you through it. Just something to think about!

Re: utility bills, is there any regular bill that comes monthly in his name? In many cases, utility companies only allow one person's name on the bill anyway (this is the case with me and my husband, so we split it so that his name goes on the electric and my name goes on the water bill). If you have any kind of bill, like the phone bill you mentioned with you as the account holder, in your name and showing your address, and some other kind of bill in his name at the same address, they'll see one name on each but will see you're both living at the same residence sharing the expenses.

Regarding 3 months worth of any evidence, the point of ROC is to demonstrate that you have an ongoing marriage, ongoing co-mingling of finances, etc. So you want your evidence to include the entire duration of your last 2 years of marriage. Some people submit every monthly bill, bank statement, etc., others submit one from every 3rd month, so it shows it's ongoing but not including every single month. I chose to include every month.

Yes, your mother-in-law testifying that you pay her/pay a portion of the bills is important. It will explain why you don't have a joint apartment lease/house mortgage, bills in your own name, and so on.
