Hi everyone,

 

I received my I-751 receipt notice and scheduled the second appointment I've had for biometrics. They took my finger prints and and my picture etc and then showed me the door. That is the last I've heard from them. I used to be able to check the status of my case on USCIS.GOV but now I can't. It reads "My case doesn't not recognize the receipt number entered." Again, I used to be able to check it but now it's gone and I'm really nervous. I haven't received anything in the mail and my conditional residence expires in February 2018. I'm kind of in the middle of nowhere.

 

My big fear is that they sent me something and I didn't receive it, or it somehow got lost between bundles of junk mail. If something like that happens what do I do? What if they send me an appointment letter and I never see it? Is my case tossed aside?

 

I know I have 6 months to rectify this but I'm starting to get really nervous.

 

Does anyone have experience with this?

You say it expires in February 2018. To clarify, did your actual green card expire in February 2017, and you got the extension letter (thereby giving you until February 2018)? Or does your green card itself have an expiry date on it of February 2018?

 

Which receipt number are you using to check your case status on the USCIS website? The one in the bottom right corner of your biometrics appointment notice?

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

No it doesn't. Your initial 1 year proof of extension expires then (assuming your 2yr GC expired in feb 2017). This is PROOF of status, not the status itself- you can get an I-551 stamp as a further years extension when the initial 1yr proof expires.

No, you don't, and it will more than likely take longer than that - especially if you are a Vermont filer.

oh okay I need to use the second number. The problem is that I'm having trouble finding that letter (yes I feel like a total idiot and can't believe I didn't put it together with my files.) if I've lost that letter is there a way of retrieving the receipt number?

I believe you are able to call USCIS to check on the status of your case with or without your receipt number (it was that way at one point, anyway, as I had to do it during another stage). What I don't remember is whether they'll give you your receipt number over the phone or just tell you what the status of your case is.

 

As mindthegap said, your actual status doesn't expire then, only your proof (the extension letter) does, at which point you can get a stamp in your passport. But I would try to call USCIS about your receipt number. I don't know if their tier 1 customer service could help you, but you could press them to transfer you to a tier 2 officer and see if that gets you anywhere. If your GC expired this past February that means you filed for ROC sometime between December 2016 and February 2017, in which case you still have a while to wait before you hear anything further anyway...they're only processing applications from summer 2016 at this point.

Okay well this is potentially excellent news. So are you saying that no matter what happens now, it's basically just a matter of time? Is there a scenario where I could run out of time and I'm no longer able to live in the country and I have to leave?

Yes.

It takes as long as it takes (see my timeline for a prime example of a long and shitty I-751), and at the moment it is taking a long time!

 

On the plus side, if you are still married in dec 2017 (to give you the exact date, add 3yrs to the 'resident from' date of your 2yr card and then subtract 90 days) you can file your N-400 for citizenship, regardless of whether your I-751 has been approved or not.

So I'm looking at my extension letter and this is what it says.

 

"Your conditional resident status is extended for a period of 1 year. During the one year extension you are authorized employment and travel."

 

To me this clearly sounds like after that one year, I'm no longer allowed to work.

No. Again, this is just your proof of resident status, not your resident status itself. When that extension letter is close to expiring, if you plan to travel out of the country, you can then make an appointment to get an I-551 stamp in your passport which is good for an additional year. That stamp could also be showed to your employer as proof of your legal status. However, you don't even need to show your employer that if you don't want to. A state ID/driver's license and an unrestricted SSN (read: one that doesn't have any notation on it like "Valid for Work with DHS Authorization" or "Not Calid for Employment") will suffice.

I have been reading your posts.You being very helpful to everyone. I personally want to say Thank You. I saw your timeline it's crazy, I understand your frustration but you have been helping everyone in VJ. I will pray that you complete the ROC successfully pretty soon. Take care, Kind Regards.

So I called Vermont today and managed to speak to the second tier. They said that I'm no longer able to check the status of my case online.

 

the receipt number that I have is the same one that they gave to me so I guess I didn't lose a document after all.

 

they said that the only way to check a status now is to call them directly.

 

i asked them the status of my application and they said it was pending. I asked for a timeline and they said the average is 6-10 months. It's been 6 months so far so I'll have to be patient.

 

they also confirmed everything that was said in this thread. I just need to get my passport stamped when it's time to extend my extension if I don't hear back after another 3 or 4 months.

 

I called them at around 9am EST and the wait was around 10 minutes total. It wasn't nearly as long as I thought it'd be. I guess I'll just keep checking the mail and call them once a month.

Sorry, but this sounds like the usual misinformation from the USCIS misinformation line.
