Hi, so I'm applying for mother's visa and have paid the aos and iv fees to NVC

 

My mom is thinking she doesn't want to come for about a year give or take a little bit.

 

Should I send in her supporting documents and financial evidence to NVC or should I send the documents to them and wait after she gets approved?

 

At the current stage what is the longest I can wait before I should submit supporting documents and financial evidence to NVC

 

What is the longest time my mom can wait before coming once she gets her visa approved?

 

Once my mom comes can she go back before her green card and social security card arrive? What is the maximum time she can stay outside of US as green card holder before coming back?

 

My mom wants to come here and stay for a month or so every 2 years. Is there something she has do so she doesn't lose her green card by staying outside US for 2 years?

she need a tourist visa. she only want to come for a month every 2 years. Did you not talk to her about what filing for her entails. She can only stay i think 6 months max without getting into trouble outside of the us when she has her greencard. Once she get approve its 6 months from medical to arrive in the states.

The purpose of a green card is to reside/live in the US.  She cannot stay in the US for only a month or so every two years.  She will find herself out of a green card pretty quickly if she tried to do that, and could be placed in deportation/removal proceedings.

 

If she wants to live outside of the US and just visit for only a month or so every two years, then a tourist visa (B1/B2 visa) is what you need to apply for.

If my comes with immigration visa she cannot complete I-131 and go back for 2 years? I read somewhere that you can apply for re-entry with that form if you are outside for more than 1 year and less than 2 years?

 

I do appreciate all your help and advice.

I don't think you're understanding...a tourist visa is not an "immigration visa".  It is for tourism.

That's a travel document.  It is for travel purposes under specific conditions.  Not for living outside of the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

even if she got a reentry permit, eventually she will have to live here, a GC is for living in the US, and she can't get permanently reentry permits

 

you can delay her getting a GC as long as you once in a while call before a year o stretch the payments, forms and documents. spread them so the process takes longer, but she should know that she can't use the GC as a tourist visa, a GC is for living in the US and immigration can take it away if the believe that she doesn't live here

Yes they'll question it. If she doesn't have assets or ties back home she won't be granted the tourist visa. 

 

The other visas are for intending immigrants, if your mother wants to only stay a month every two years than that isn't what she should apply for. If immigration finds out she isn't planning on staying in the United States she'll get denied. 

 

Don't worry so much about cost, worry about what visa is the correct one. Applying for the wrong visas will cost you more money in the long run because she'll  keep getting denied.

if she has weak ties to her home country the immigrant visa might be the way to go, at first.

she applies for and gets the immigrant visa, comes to the us visits and such and on her way out she relinquishs her greencard.

then she goes and applies for a tourist visa so she can visit.

the reason she gets the immigrant one first is to show she has no desire to remain in the us since she was already able to but chose not to. since the point of ties to your home country is to make sure the tourist returns at the end of the trip and does not stay here.

also a tourist visa is much cheaper than getting a reentry permit.

However, their is a good chance she cant even get a tourist visa then so then a GC and visit and give it back and they will give you a tourist visa! its a catch 20.
