dgv76,

In answer to your first question, did you read the I-130 instructions?

In answer to your second question, think ahead to how the K4 child is going to become an LPR.

Yodrak

Do I need to file this form for a 5yr old, when I file I-130? And I am not sure if I need to file I-130 if a child will get k-4 visa.

Please help.

Thank you

Specifically, the answer to the question is yes, of course. The instructions are very clear on that. You did read the instructions, right? For success, this process requires a clear head and attention to details. It also requires that you make the effort to understand to overall process well enough to grasp what's coming up.

While it's perfectly ok to ask questions about specific details, some questions, like this one, let everybody know you haven't put enough effort into understanding the process to have much chance of success. Nobody wants to repeatedly type a full explanation of why the answer is yes, or lay out the process for you and others each time their/your questions indicate they haven't read and understood the guides already carefully prepared for them.

The fact is, you don't have to do the I-130 for the child at the same time as the parent but you might as well. The child cannot adjust status after arrival without an approved I-130. A parent can sign for the child.

Facts are cheap...knowing how to use them is precious...

pushbrk,

The answer to which question? (If the first, you might want to re-read the I-130 instructions yourself.)

You don't have to file the I-130 now for the child but will eventually. It boils down to WHEN not if. However, for the G-325a it's only for the petitioner and the beneficiary not the child. I know the instructions can be confusing b/c it was for me.
