BAN: Mother In law Tourist Visa

Good day all,

 

I would like to start the paper work so I can bring my mother in law to visit for the holidays. I recently married my husband and brought my husband to the US in a k-1 visa. We then married and it's been 7 months since we submitted his green card application. However, I would love to surprise him with a visit by his mom.

 

His younger brother is a US marine as well as a born American citizen (which I hope can help her case).  About 19 years ago, my mother in law was deported for overstaying here in the US on a b-2 visa. When she tried to reapply she was denied do to a ban (which I am guessing is the 10 year ban). 

 

We honestly only like her to visit and she does not wish to move here. Is it possible they can grant her the visa, even if the only tie she has in Jamaica is the house she owns ? We was also hoping the deportation that happened 19 years ago doesn't come up.

The deportation might come up because the DS-160 asks about visa revocation, deportation etc. And with so little ties in Jamaica, it's a lot more difficult for her to get one. Besides, your husband and his brother are both soon-to-be LPR and US citizen respectively. Holiday outside the US together maybe?

Thank you. I will have to compromise and miss holidays with my parents and siblings as well.

FYI, invitation from you and/or your husband won't be helpful. There is also no such thing as sponsorship. Just thought I'd share in case you wonder subsequently.

 

Sorry that you might have to miss the holiday season with your family. But hey, you can see them anytime in the US after you visit or vacation with your mother-in-law

The service and legal status of your brother-in-law will have no bearing on the application for your mother-in-law.

She was deported on her first tourist visa for an overstay, and then denied on her second tourist visa application.  Both previous applications will be in her file when she applies the third time.  How soon in between the two applications?  When was her ban officially over?  Trying to gauge a timeline here between applications to see how long it's been since she applied for a tourist visa after the second one was denied.

Property in her name is a very good tie.  Does she have immediate family living in Jamaica still?  Does she work?

It will definitely come up.  The second denied application will come up as well.

Because her deportation was due to a B-2 overstay she will always be denied.  They cannot trust that she will come back regardless of if her ten yr ban is over.

She actually applied 2 times after the ban. Both during the first 5 years of the 10 year ban. The ban ended 9 years ago.  The house is under her name and she still has 4 kids who live in Jamaica, all who are well over there 30s. She also helps my sister in law with the caring of her children while my sister in law goes to work during the week.

Her children aren't minors anymore, so that idea as a tie is out.

Looking after her own grandchildren isn't considered employment in her home country, for the purpose of a tie.

 

Sorry but other than the house she has no ties to prove she would return---and she is very hard-pressed already to prove she would return because of her prior overstay.  I think you will need to look into taking your husband on a surprise trip instead.
