Hi all,

 

I'm filling out the I-751 form and I want to make sure that I'm doing it correctly. My first question is about the (Other names used), do I put none next to each space or just leave it blank? another thing, do I have to put the A- number? section 15a (in care of name), do I put my name in there? We still don't have any children, do I leave the whole section blank or do I need to put N/A next to each space?

 

I need help with this form please!

I personally left blank the things that did not apply to me. Some people also put "N/A" only in the first space of each thing that does not apply to them (so for example, in the section for children, they put N/A only once in the spot for child #1 and leave all subsequent spaces blank). If you choose to put something in the spaces that don't apply to you, I'd suggest putting "N/A" for anything to do with names, and "None" for anything to do with numbers. The reason being, USCIS has been known in the past to take that "None" literally and interpret it as an actual name, as in the case of one person who put "None" in the middle name section and subsequently received correspondence from USCIS addressed to John None Smith. :) 

 

Yes, put in your A#, it's right on your green card. 

 

The "In Care Of" section would only apply if someone else would be receiving your mail for you. For example, if you were going to be away and had your USCIS correspondence directed to a relative or friend's mailing address, their name would go in that section.

Thank you very much for your quick response! The form I'm filling out on the computer doesn't accept the (/) symbol, so putting N/A can only be done by writing. This is so frustrating! I have another question as you do seem very experienced. My wife owns the house and she's been paying a mortgage for over 10 years now, so we don't have any sort of a joint lease or mortgage or even a joint ownership of a car. Is this going to affect our application badly by any means? We do have a lot of other evidence to provide to USCIS though. One more evidence that I'm still hesitant to include is the utility bills, I have been just recently added to the gas and garbage bill only for the sake of this application and we only have one bill of each that has both of our names on it. I don't want to be sent an RFE just because of those bills requesting bills that cover last year for example. Is it still good to include those or just forget about them?

Yes, it's fine to just write in the N/As by hand. 

 

They like to see evidence of joint ownership, tenancy, etc., but I know a lot of people don't have that for a variety of reasons, whether their spouse already owned a home like in your case, or they live with relatives whose names are the ones on the lease/mortgage, and so on. Provide as solid a case as you can without those items. In our case, our apartment complex will only name one person on each utility bill, so we put my husband's name on the electric and mine on the water/sewer/garbage bill. They can still see the dates on each bill and that they're both going to the same address. Include what you have, at least your name is on some of the recent ones even if not a lot. Where possible, you want your evidence span the duration of your marriage, but that's not always feasible with every piece of evidence like your utility bills. 

 

You mention you have a lot of other evidence which is good (joint car insurance, joint health insurance, joint life insurance, tax transcripts not tax returns, wills and powers of attorney, joint bank statements and credit card statements, etc.?), but if you feel your case is not strong enough without the items you mentioned, you may opt to have friends/family members write letters of support on your behalf verifying that they are witness to the ongoing legitimacy of your marriage, and include those in your package. Many people do not include these and they're not a "required" item but it's certainly an option.

Thanks again! We do have joint car insurance, life insurance from both of us, one joint savings bank account, joint credit cards, tax transcripts and W2s, I have a 401k plan with my wife is the sole beneficiary, 3 affidavits from 3 people who know both of us and have been aware of our relationship from the time it started until today. We also have a lot of pictures with family and friends and when we were on vacations. I don't know what else to include, I want to send everything to the USCIS before the end of this week.

I'm sure others will chime in but that all looks like a good start. How about wills? They can be done quickly and cheaply and many more experienced users have advised that's one of the strongest pieces of evidence you can be provide. You mentioned vacations; if you have any old boarding passes, hotel bills, etc. with both your names on them showing you stayed in the same room or flew on the same flights, you can include these as well. Do your state ID/driver's licenses show the same address for both? 

 

Also keep in mind that with the processing times the way they are right now, by the time you got an RFE (IF you were to get one, not saying you would), you'll have that many more months of evidence that you could submit. So in the case of the utility bills you've just started getting in both your names, even if you only have a couple right now, you'll have a bunch more that you can provide later if need be. The point is to demonstrate co-mingling and the ongoing nature of the relationship, so subsequent bills will show that.

 

I filed at the beginning of July but since then I've just been amassing additional evidence as it comes my way so that if I were to get an RFE for any reason, I don't need to go find it all, it's ready and can be popped in an envelope and sent back. Things like cards, wedding invitations, etc. addressed to both of us from friends, letters from the charities we jointly support thanking us for our support, gym memberships, each new utility bill/credit card/bank statement that comes each month.

Thank you! Yes I did include both of our driver's licenses with the same address on it. We still have the tickets and hotel reservations for our vacations. Is it too late to get a will or a power of attorney? I hope that you get approved right away without the need to go through all the hassles of RFE.

When did your filing window open? As long as your 90 day window isn't up then you have time to do it. We did our wills last year and it was super easy. We don't have children, property like a house, or a lot of assets, so depending on the complexity of your situation I don't know how much more complicated it would be.
