My husband is American and in 2014 we applied for a visa so that I could join him. But since we were married and he left in the United States he stayed there 7 years without coming back to me because of His studies he wanted to finish and have a good job. I specify that he has American nationality. Afterwards when I had an interview at the embassy the agent refused the visa application for lack of proof By this That it lasted down without returning. Subsequently on na discovered that our marriage certificate was not well registered at the level of the town hall. All these circumstances made that the request was refused and all the papers were Returned to the United States for verification. My husband came in 2015 to try to fix the situation more it was impossible. Now we decided to drop this case and file a new application with all the papers in full without recourse. The question that arises is this what made love? Is there among you ya kelkun k-3 visa was refused? If so, how did you do something else?

So are you planning to file for IR-1 visa?  The K-3 is very, very rare now.

Where are you and your husband living now?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I live in Senegal and my husband was there for the holidays for two months he returned to usa last month.

Why file a K3?  Why not file an I-130 or I-R1?  You have to proof that you and  him kept in touch during his time away from you.  A lot of people here say the K3 are usually rejected, but I am not 100% sure if that's true but I can tell you that even the K3 if it goes through will take some time.  My K3 was submitted over 6 months ago and still no progress.  But I filed an I-130 before my K3, so I am actually waiting on 1 of them to get approved.

 

But as far as supplying proof, you need to show that you and him kept in touch during the separation....call log/emails/IM/text,etc.  Photos would help too.  But to be honest with you married for 7 years and only spend 2 months together if I understood you correctly is kind of unique if you ask me, but I am not a USCIS Office :)

Whether you'll have problems or not is unknown, but your husband is certainly allowed to file a new petition to begin a new visa process.

All the documents from the former case were returned to usa and the American emigration service told my husband that we had the choice between seeking the application or simply canceling.and we decided to cancel.
