Hello there,

 

I am English and have my interview at the London embassy on 30 August for my K1 visa application. My fiance and i have been travelling together in Australia and NZ for the past two years and have both been working, but my fiance does not have any evidence or income from the US. We are back in the UK now until my interview. 

His dad is acting as our co sponsor, but i am worried that we don't have enough evidence. His dad is retired but has stocks (which we have a statement for) to cover the poverty guidelines. He also has a property and income of $35k. We have one statement which shows all deposits, but it is not on official bank paper as apparently BOA does not offer that service. We do have a letter from BOA which states when the account was opened and the average balance of each account. I worry that this is not enough?

 

Can anyone please help to put my mind at ease?

My my fiancé or his dad are not self employed so have not filed taxes and my fiancé did not earn enough abroad to file his taxes back in the USA. 

 

His is dad has his boa print out, plus a letter from them and also a statement declaring his stock amount. Do you think this is sufficient?

For London, if your fiancé earns no money then he doesn't need to provide anything. It's all on the Dad to be the sponsor. I find it odd that you said he has an income of $35,000 but has not filed a tax return. That has nothing to do with being self-employed. If you earn money, you file a tax return. 

 

I'm going to pass on if I think you have enough because you haven't really said what his total assets are that you want to show on the bank and stock statements. Is it $100k, $500k? Don't know so no guess.

I didn't know that as I am from the UK. It only says to include a tax return as evidence if you are self employed. He has not filed a tax return for 2016 as there was a complication with it due to something concerning his ex wife. He has permission to file it late and will be doing it when he has the documents he needs from his ex wife. I don't know the full story on that.

 

He has $35k annual income from his pension, which is shown on his bank statement of deposits. We also have a letter from the bank with the average balance across his accounts.

 

His stocks are worth approx. $45k and this is shown on his account statement from June. 

 

He also has a property, but it doesn't say to provide evidence of this.

For his proof of income, get a letter from the pension department that provides the pension.  It will be just like having an employer letter that people will mention as good evidence of income.  It will state the name of the  company and that he receives $35,000 annually for life....or something similar. That is all you need to prove because it is enough. You can skip the BOA printouts and stocks or take them along as extra. The pension letter will be the best thing if you can get it in time.
