Is it possible to leave the country while your visa is pending. I am also wondering if you have been approved for your work visa are you able to leave then?

This is something i've always really wanted to know the answer too, i believe you can travel whilst its pending but you need some pretty good evidence to show the guys at the port of entry that you will definately be returning to your home country. I THINK.. i'm sure someone will clarify this for us...

which half of the equation are you, and what visa is pending? You don't have a timeline, and your post is kind of ambiguous.

If you are the foreign half of the equation, sitting in your home country waiting for approval of petitions for a K3 or CR1, yes of course you can travel. Anywhere your heart desires and you are legally permitted to go if you have the proper travel documents.

If you are the USC sitting in the US waiting on your petitions to be approved, yes, you also can travel, whereever and whenever. As long as you have someone to pick up mail for you if you get an RFE or approval notice.

If you are the foreigner, sitting in the US waiting on something or other to be approved and you want to travel, well that would depend on your current status in the US. If you have a K3 and you're waiting on AOS, yes, you can travel. K3 is a 2 year multiple entry visa. If you are K1, no, you cannot travel until you get either AP or AOS. If you are in the US on a tourist visa, and got married and decided to apply for AOS, no you cannot travel outside the US until you get your green card. AP is a possibility, but not advised.

Hi I assume you are the foreigner, you are outside the US and with travel you mean to the US. There is no law that prevents you from trying. It is not illegal, on the forum there are planty of examples of people that did it while waiting for K1, K3 or IR1 visa. You only need evindences that you will go back to your home country and that you are not immigrating to the US. So according to other experiences, a home, a job, a bank account a phone bill is what you need to have with you. I personally know people that went back and forth from the US on WVP while K1 pending and they were asked about their job, nothing more.
