I need some big help. Me and my fiance want to file for the K1 visa. He will be coming from England to the us. I make around $2,000 a month. But we are both 21. This is my first job so i haven't  ever filed taxes or anything before hand. Will it be impossible for us to file for it till i work more?

If your income doesn't meet the poverty guideline, you can get a co-sponsor :) So ask around before you file. Could be your parents, a close relative or friend.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

The requirement is around $20,000 gross pay for two people. Gross pay means before its taxed. If you don't have tax returns to prove sufficient income but your job does pay you over the requirement you could have your employer write a letter stating how much your gross pay is a year or alternatively you could get an HR letter.

 $24,000 a year is enough if it's only two of you. You don't prove Income until your interview in London. They will accept an employer letter as proof of your current income. London does not require a tax return for a K1.

 

Then later on down the line----

When he adjusts status after marriage, you need a tax return for a new affidavit of support. You will have filed your 2017 tax return by then. They also accept a statement of why you were not required to file if you have no tax return. I was unemployed in 2016 and earned no income so was not required to file...something along those lines.

What do you mean london does not? He'll be  coming to the us. So they wont ask me for my tax return or? (Sorry alittle confused)

What is an HR letter? And would it need to be notarized??

You will read in these forums that with a K1 visa, you must supply a tax return at the US Embassy where he has to go interview to get the  visa. You have never filed so don't have one.  He will interview in London, where they will let you prove your income other ways besides a tax return.

HR stands for the Human Resources department of big companies. You may just have a boss who will write a letter saying you are employed, how many hours a week and what your yearly or even monthly income is. It does not have to be notarized.

It does not help to have few expenses. All they want to know is how much money do you make in a year. If you make $2000/month, then younfill out the form saying you make $24,000 a year. Then you prove it with an employer letter. 

 

While you are planning, here are the current costs you can expect

 

K1 fees

$535 Fiancé Petition (USCIS)

£45 police certificate (ACRO)

£300 medical (Knightsbridge) pay at the appointment

$265 visa fee (Dept of State/Embassy) pay online 

$30 or $0 (Courier) home delivery or pick up at depot

$1225 AOS/EAD/AP (USCIS)

It's a certificate that shows that he doesn't have a criminal record in his home country so kind of like a background check yes. If he doesn't have a criminal record in his home country the certificate will come back no trace.

Hey Anakii....check the follwing and that will help you sort out your issue.https://www.uscis.gov/system/files_force/files/form/i-864p.pdf . For K-visa you will be looking at "100% of HHS Poverty Guidelines" and 125% when you do the Adjustment of Status.

 

You may ask your parents, friends or colleagues to co-sponsor you the remaining amount that's need to sum it up.

Hey... I am from India and the US embassy wanted a police clearance certificate from my country. Additionally, I was in UK for 4 years and I had to submit a police certificate from UK (ACRO) because the requirements suggests that you get a police certificate from all the countries you have lived for more than 6 months from the age of 16. Also i was in Dubai in for 10 months but i didnt get it since VO didnt ask me. I only took Indian police certificate with me to my interview but when the VO asked me for UK police certificate i said i didnt have one, he told me that he needd it but won't be requiring a police certificate from Dubai, UAE. Anyways the interview was put on Administrative Processing and it took me nearly 20 days to get a Police Certificate form UK and mailed it to US Embassy and after a week my visa was issued.

 

Getting a police certificate is easy, he can just walk into the police station in his area and apply for one with a small fee and he will have to show the Interview Instructions paper where US consulate/embassy is asking for a police certificate and so when they prepare the police certificate they will address the document to US consulate/embassy.

No this is not the process for a UK police certificate and London interview. It is ordered from ACRO and comes in the mail to the intending immigrant. He takes it in hand to his medical exam and his interview.

Oh ok. Well, even i ordered my UK police certificate online form ACRO because i was in India. Yes, they can either apply by mail or online. I didnt know that they have to take the Police certificate for his medicals. I guess, different countries different procedures

Yes, they are very different once you get to the consulate part of the K1.

There is only one place to get the medical for London. They ask to see the police certificate, presumably to see if there are any drug or alcohol related incidents for their mental health evaluation, which includes substance abuse.
