so i asked about this in my other forum but that started for a different reason i wanted some help on the fee wavier for ROC as well i want to file ive been trying to save but we dont have enough money and we might end up losing our house in november, chance we could become homeless as we cant barley afford rent here let a with the family discount loan payments and i recently lost a job started working again now but i dont get many hours all my husbands money literally goes to bills to keep fed and housed right now all that wondering weather i should file for it im scared i dont want to risk being deported but i dont really have the money for it and saving right now is so hard because of the financial situation that just hit my green card will expire NOV 4th i was gonna try saving some of my money now i have a job till then but the i really dont get alot of hours or money due to union fees my husband already works 2 jobs we barley have enough for bills like right now i had to put any money i made into the bank as this bill cycle we have $12 left over out of $1800 just alot with car payments loan payments credit cards and now this living situation where we could lose our place to live we only found out about this recently also as my father in law owns the house like i said so we live with him paying a set amount of rent ect. but his business is being close down due to the location in the city for a year and half and he wont have an income to keep the house

I'm not sure if that's your actual question, or you have a question about the requirements for it?

Perhaps a friend or family member can loan you the money for the filing fee?

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

You have 2 options since you don't want to lose your status:

 

1.  File ROC with the fee waiver as instructed above

2.  Borrow the money to file

 

You are 1 week into the 90 day window, so you can file now.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

yes i just wanted to know if i could file a fee wavier and if i did what would happen honestly i dont want to mess my self up and get deported so stressed about this dont want to leave my husband

The documentation states that a waiver can be filed for ROC.....but make sure you provide sufficient evidence that you can't afford to pay the fee......

well i plan to get a letter written by my father in law stating his business problems ect and saying how he cant afford the house and all that and a letter from us showing bank statements and loan payments ect. showing we dont have any money to put away as everything we could get rid of like you guys internet tv and phones all are contract so we cant unless we buy them out we dont even have medical insurance because we cant afford it were below poverty guidelines now as my joint co sponsor for adjustment of status was my father in law so now its just me and my husband and honestly and me losing my job was super hard as my husband took a second job just to provide and keep us fed clothed ect and he cant give any more money to it as he is paying all the bills and we have a loan payment which we got to get his car months ago as he needed a better job

You're going to need a lot more proof than just a letter from your father-in-law.

 

Have you read the links provided above and in your other thread about this?  Can you ask a friend or family member to lend you the money and you pay them back once you are on your feet again?

 

I know the stress is killing you right now, but you need to slow down, and read the info provided first.

no my family back home most of them has passed away or are children his family is the one having the financial hardships aka his father in law :/ thats what i mean i have no one to lend off and my husband has a loan under his name still being payed so he cant get another and i dont think i even qualify since i have 1 credit card as my credit stamp in the USA which has been fully used for the last 2 months as i was out of work

Do you or your husband receive food stamps, WIC, federal or state benefits or anything like that?

 

Check the poverty guidelines based on your household size to see if you are at or below that.

 

If you use food pantries or anything like that (church collected donations, community organizations you've used for assistance, etc.) get them to provide you with a statement relating to your need of their support verifying your situation.

 

Having a credit card doesn't mean that you don't qualify.  You really need to look at the guidelines in what is considered evidence.

my card expires nov 4th this year i have a over 2 months left why its getting to me i have been saving but this i suddenly had to use all my savings to help us also no we filed married without my father in law as before this we had the problem of me being unemployed but we were fine now not so much as its last minute and we have to much to pay for now i really dont know what stuff to show honestly as the problem is with the living situation and making sure we dont become homeless due to his circumstances

The immigration process is stressful enough, even without having to worry about how to pay for it----so of course it's understandable how fretful you are about this extra strain now.

 

All in all, you MUST file for ROC to prevent losing legal status.  Right now your focus needs to be on reading the info regarding how to file for a waiver, and looking at the form instructions to figure out what type of evidence you can provide.  USCIS recognizes you may not be able to provide everything they are asking for in your waiver application, so they do give you several options to plead your case for exemption from the filing fee.

 

These are the instructions which tells you what they will accept as evidence towards obtaining a fee waiver, and how to fill out and file the form.  At least read this tonight, it may help put your mind at ease a little bit when you see what is required---because you may have a better case than you initially thought.

Thank you all so much for helping me honestly hard to sleep but I do feel a little better it's hard knowing theirs not alot, I can do. And my husband's already done so much, question though if I file the fee wavier and it is denied what will happen will I be deported or will they let me refile and pay the amount honestly I could probably get the money if I could save a little at a time but right now I can't get $680together

Only waiver would be denied, not your I751 petition. If that happens they will send you everything back and you will have to file it again, this time with a check.

Keep in mind that I751 has to be filed before GC expires, with or without waiver.

 

Please someone correct me if I'm wrong.
