Hi again guys.I have a question,on the i864 it says household size ,and my join sponsor is my father in law.He has 4 children including my wife ,and they are all over 21 ,and he is married .He declares his taxes as single .What should the number or the filling be ? Thanks

if he is married, how can he declare his taxes as single? he has to declare his taxes as married filing jointly or married filing separately

 

anyhow he is married, if he is married and not filing as married, then he is committing tax fraud

 

if his children aren't his dependent and declared on his taxes, then they aren't part of his household size, but your mother in law is

Nobody ,it just says single ,and there is no dependents anywhere

Maybe he declares them separately just like you said ? Cause here it says single on the form

No he lives in the same house with my mother in law .Can he file separately ? Cause i don't get it lol,pr the only option is that he was never legally married ? I don't think thats the case tho

Yes, they can do "married but filing separately". 

 

I think that if your father in law does not claim dependents, his household size is 1. So to sponsor you, then his household size would go up to 2. 

 

Is your wife presenting her income and claiming herself in that? (I'm assuming she works.)

 

But you need to figure out the deal with his wife.

I just spoke with my wife .She said they claim single cause they are not legaly married lol.Anyway ,my wife works,and i filled the i864 form and i864A for her ,but she doesn't make enough .Now i'm doing my father in law forms ,and i'll just put 1 under person you are sponsoring on this affidavit and 1 under person not sponsor on this Affidavit 'yourself' .That should be right ?

who are you petitioning then?

 

if you are filing the i864 and your wife the i864A, then who are you petitioning?

 

if you are filing for your wife, then she doesn't fill the i864A

 

I'm confused because you don't mention who are you petitioning

I'm sorry my mistace.So i'm the f1 student applying for aos.My wife is my sponsor ,and since she doesn't make enough,my father in law is the joint sponsor.He is single with no dependents

so she files the i864 and her dad files another i864 as her joint sponsor

 

the household size for each is 2, unless you have children

 

if not, you and your wife is one household size, and she will fill 2 on her i864, on your father in law's i864 it will be 2 as well, himself and you as the beneficiary, 2 for household size

Hi! Just want to ask about my situation. I'm filing for my husband and I'm a permanent resident. I'm unemployed so I will ask my stepdad for affidavit of support. When he file tax, me and my 1 yr old son is his dependents. Will that affect on the petition of my husband? Or it doesn't matter? And how do we count household size?
