If you've ever sat in federal immigration court, you check 'yes' to whichever describes your situation. Even if you have had removal proceedings terminated from a notice to appear, it is still yes. It won't be held against you either. 

 

I second everyone else. It should be super obvious if you need to check any of those three.

I'm an English-speaking U.S. citizen, and I would have a question about the definition of "excluded."  My husband was denied a tourist visa before his K-1 visa was approved.  Would that qualify as excluded?

No.  Unless it was in front of an immigration judge
