how to proceed? Im confused.... K3? IR1?

Ok here goes...

I have been living in Morocco for almost a year now with my fiance, hes <oroccan. We are collecting our paperwork to get married right now. Within the next 2 years we want to move back to the US. I am currently waiting on my civil id card because i appled for residnecy here, although I maintain domicile in the US (I fiel tax returns and maintian bank accounts back home). I also collect SSDI, which is below the income level for the AOS.... my assests dont fufill the requirements either. His Aunt who lives in Ohio may be able to sponsor him but we arent sure. I am wondering how my being a residnet here and living in Morocco with him will effect this whole visa process and obviously the AOS issue... any help, information or advice anyone can give would be greatly appreciated.

living there it will make it harder to prove us residency but will be good relationship evidence. it does not mean anything for the aos since that is once you both get back to the us.

 

keep in mind that since you are on ssdI and he is from morocco you will need to show you are not bringing him to the us as free help and he is not using you for a greencard.

Using his aunt as a co-sponsor could be a red flag, especially considering that you are going through a difficult consulate (Casablanca). They could see this as his family trying to use family members already in the US to bring other family members here...I think it would be safer to use someone who is not related to him as a cosponsor, but that is just my opinion. 

 

As for proving domicile, the tax returns and bank account will certainly help you, and you could also submit voting record proof, any sort of property or bills you may have in the US. 

 

Just general advice for someone going through the Casablanca consulate (my husband is from Morocco, he came to the US on a K1 visa), be sure to include solid relationship evidence in your CR1/IR petition. You say you have lived together for almost a year, so that should help you a lot. Be sure to address any red flags that you may have, age difference being a common and big one if it applies to your situation.

August 9, 2018: AOS Interview (Approved)

August 9, 2018: "Card in Production"

August 16, 2018: Green card in hand

 

 

May 2020: ROC!
