Hello everyone. I am living in Sugar Land Texas for 2 months now and got married last Saturday. I am planning to change my first name and my gender marker into female before applying my AOS but I don't know if this will be possible in a short period of time cos I have 25 days till my 90 days visa expired. Is changing my first name will be faster than doing it both? if so can someone help me about the step by step on how can I change my name here in Texas. Thank you very much.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

In short, you'll have to go through the court. However, to change your gender marker, it might not be that easy given the more conservative judges in most of TX.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Just go to Social Security Administration office to update your SSN card (if you have one, otherwise, skip this step) with your new surname (make sure you bring your marriage certificate).  Then mail the marriage certificate with the application - file in your new name. No need to go to the court to change your name.  However as for gender change - check with the State of Texas.

Whilst it would be good to send in adjustment papers before the 90 days is up to avoid being without status it isn't required so long as you married within the 90 you can adjust as a fiancé visa holder who married their petitioner. You would be at risk of being picked up but it depends on if you would be comfortable waiting to change your green card until the removal of conditions if you decide to do your first name change and gender marker after the green card application.

 

Google your county's name and clerk office, their website should hopefully have a phone number so you can ask about the  gender recognition change process. 

 

You could also contact some LGBTQI groups in the area, sometimes they have legal teams or a drop in legal advice but usually this is only once every few weeks so would need to contact them to find out when.

You should figure what ID you would be using after you do that you intent. Your passport would show the wrong name and gender. You should check what you need to get a state ID in Texas because if you need your passport, it can get tricky. Or, you might have to wait until you receive your EAD

 

I don't know the answer and I am just putting it out there because you don't want to end up with no ID. 

 

I think this is why waiting until ROC (like @Illiria mentions) might be another way to go about it.

USCIS is so not the group I would worry about dealing with a gender marker change. The Texas courts might be as they could drag their heals. OP if it takes longer to change gender marker maybe changing first name now and gender marker later would be a good compromise? 

 

The trouble with waiting on both changes until after aos is when your ID does not match your gender identity expression especially in a conservative state, hell I live in California and people I know can run into issues as their ID doesn't reflect their gender expression. 

 

OP this is such a tough decision on which way around to do this, if you had come on here before deciding which visa and from a country where changeing name and gender marker wasn't difficult I would suggest change name and gender marker and then apply for the visa especiallly moving to a conservative state - sorry this doesn't help now but might help someone else in a similar situation.

Actually, Kris&me, above, has posted a link that shows how to change gender marker in TX with relative ease. I have also seen stories on youtube of people changing their gender marker in TX with relative ease.

Good to hear. Did not check your link. My response was based on what I previously read when the OP asked similar questions few weeks back.

Sweet :-) that's great news for OP. If it's Same process as first name change and there are judges that are cooperative then totally do it before aos.
